Even though it might not be the most romantic subject, before you get married, it is essential to consider the advantages of an antenuptial contract.

Advantages:

1. While many people are of the opinion that drawing up an ANC is a way of preparing for divorce, it is not. An ANC protects your and your spouse's assets against creditors and the lengthy process of estate finalisation in the unfortunate event of the passing of your spouse.

2. Failure to draw up an ANC, you are automatically married in community of property and both your Estates are regarded as one.

3. Having an ANC in place ensures that you and your spouse are seen as separate legal entities, protecting you from your spouse's creditors.

The lawyer who draws up your antenuptial contract must be a registered notary and must advise both parties to enable you to make an informed decision.

We are proud to announce that our firm has experienced such growth that we have decided to appoint another attorney and director, being Ms Brenda Brand.

Ms. Brand completed her LLB degree at the North West University of Potchefstroom and was admitted as an attorney of the High Court in 2010 and has since practiced as such at numerous successful law firms. Due to the aforementioned appointment we have decided to change our firms name to BLR (Brand Le Roux) Attorneys and have moved to a new office, situated at 18 Mandela Street, Witbank, eMalahleni.

We look forward to the new phase our firm is entering and our offices will continuously strive to deliver meticulous and unrivalled service, while building a long-term client-attorney relationship.

Renting out your property? You might at some point down the road face a problem of a non-paying tenant. If the situation is not dealt with urgently and efficiently outstanding rentals will accumulate rapidly due to non-payment by the Tenant and you might face serious financial repercussions.

In terms of the PIE Act no person may be evicted from their home without a court order. The Court will only grant an eviction order if the Court is satisfied that all the requirements of Section 4 of the PIE Act have been complied with and that no valid defense has been raised by the unlawful occupier, and the Court is of the opinion that it is just and equitable to do so after considering all relevant circumstances. It is therefore important to comply with all the requirements of the PIE Act and to place all relevant circumstances before the Court when bringing an application for eviction.

It is always best to contact your lawyer when you need to evict non-paying tenants.

WHAT IS A CONTRACT?

A contract is a voluntary arrangement between two or more parties that is enforceable by law as a binding legal agreement. It is not advisable to draw up contracts yourself or rely on “off the shelf” forms readily available these days.

Each contract is different and unique and requires the services of an attorney. This will ensure that many future pitfalls and problems are avoided and that your rights and interests are protected at all times.

If the person or company that you have contracted with is in breach of the contract, you will urgently require the services of an attorney. Avoid problems before they arise by consulting with an attorney when you require a contract and or when signing any important contracts.
