Make Sure You're Compliant when hiring a Foreign National.
Did you know that employing a foreign national without verifying their right to work in South Africa could expose you to serious legal consequences, including criminal penalties, even for domestic workers employed in your home?
✅ Before You Hire, Check:
• Verify the employee's passport and immigration documents
• Confirm they are legally authorised to work in South Africa
• Ensure their permit allows the specific job they will perform
• Keep copies of all documents and monitor expiry dates
• Follow proper labour procedures, as foreign nationals still have employment rights
What Employers Need to Know Proposed changes under the Employment Services Amendment Bill could introduce stricter recruitment requirements, employment quotas, skills transfer obligations, and possible fines of up to R100,000 for non-compliance.
Important: The Bill is not yet law, but current immigration and employment laws already place obligations on employers.
