1. “I didn’t read it” usually won’t undo your signature.
Someone says: “It’s just the standard contract.”
You sign without reading it.
Later, you discover a clause you never knew was there.
A signed agreement can still bind you even if you didn’t read it first.

2. I stop at the words “FULL AND FINAL SETTLEMENT.”
Imagine someone owes you R80 000.
They offer you R50 000 to end the fight and you sign a document indicating you accept payment “ in full and final settlement.”
You are actually ending the dispute there — not that you’ll take R50 000 now and fight about the rest later.

3. I check HOW the contract says I must cancel it.
Sending:
“Hi, I’m cancelling 👍”
on WhatsApp may not be enough.
Your contract might tell you exactly where and how an official cancellation must be sent.

4. I search for the words “personal surety.”
You think you’re signing something for your company.
But if you also sign personally as surety, your own money or property could be at risk if the company cannot pay.
The legal implication can be huge.

5. I don’t assume a WhatsApp automatically changes a signed contract.
“But we agreed to change it on WhatsApp!”
Your original contract may say changes only count if they’re made in writing and signed in a certain way.

6. I KEEP the boring paperwork.
Proof of payment. Cancellation letters. Emails. The final signed contract. Settlement agreements.
Because three years later, someone might say:
“You never paid me.”
And suddenly that boring proof of payment becomes VERY interesting.

Paperwork feels boring when everyone agrees. Lawyers learn how interesting it becomes when people don’t.

Before signing something involving serious money, property or responsibility, let Jacky Venter Inc help you understand what you’re agreeing to.

Happy Birthday, Sonti!

Wishing you a wonderful birthday filled with love, laughter and all the little things that make you smile.

May the year ahead bring you happiness, beautiful memories and plenty of reasons to celebrate.

“We don’t need to put all that in writing. We’ll work it out.”
Maybe you will.

But these are the little things that can become BIG arguments later:

1. “Every second weekend” isn’t always specific enough.
Who collects? Where? What time? What happens on long weekends? What if someone is late?
Tiny details not agreed on... until there is a dispute.

2. A parenting plan can cover much more than where your child sleeps.
Schooling. Holidays. Birthdays. Transport. Contact. Maintenance. Even how important decisions will be made.

3. Moving away with your child isn’t always simply your decision.
Imagine one parent wants to move to another province or country and the other parent suddenly can’t manage their normal contact with the child.
That move can become a legal issue, especially if there is already an agreement or court order in place.

4. Your child’s opinion can matter too.
That doesn’t mean “the child gets to decide.”
But depending on their age and maturity, their views should be properly considered.

5. A parenting plan can become legally enforceable.
It can be registered with the Children’s Court or made an order of Court in a Divorce Court.
A parenting plan isn’t written for the days when you agree.
It’s written for the Tuesday night, two years from now, when you don’t.

Separating? Let us help you put the small details in writing before they become big fights.

“I thought I could still change my mind.”
That’s a sentence you don’t want to say AFTER signing an Offer to Purchase.
Before you sign:

1. An Offer to Purchase can become THE contract.
It isn’t simply saying: “I’m interested in buying your house.”
Once a properly signed offer is accepted, you may already have a binding sale agreement.

2. Don’t assume you automatically have a few days to change your mind.
Don’t sign on Saturday thinking:
“I’ll decide properly on Monday.”
Cooling-off rights only apply in certain circumstances — not every property sale.

3. “Subject to bond approval” can be more important than it sounds.
Imagine you need a R1.5 million bond.
The bank approves R1.2 million.
Now what happens to the missing R300 000?
That can depend on exactly what your Offer to Purchase says.

4. What happens to the chandelier?
Or the generator? Curtains? Pool equipment? Freestanding stove?
If you’d be upset to arrive on moving day and find something gone, make sure the paperwork says what stays.

5. “Voetstoots” doesn’t mean a seller can deliberately hide a serious problem.
There’s a big difference between a defect the seller genuinely didn’t know about and one they knew about and deliberately concealed.

Your signature doesn’t say:
“I really like this house.”
It says:
“I agree to what is written here.”

Before signing, let us help you understand exactly what you’re agreeing to.

1. I stopped matching their energy.
Someone gets louder. They speak faster. They want you flustered.
I’ve learned to do the opposite: slow down.

2. I stopped giving instant answers just because someone demanded one.
“You need to tell me NOW.”
No, I don’t.
“Let me think about that and come back to you.” is a complete response.

3. I stopped over-explaining myself.
When we’re nervous, we tend to explain... and explain... and explain.
Sometimes:
“No, that doesn’t work for me” is enough.

4. I learned to ask questions instead of immediately defending myself.
“You always make everything difficult.”
Instead of launching into a defence, try:
“What specifically are you referring to?”
Now they have to explain the accusation.

5. I stopped assuming confidence means someone is right.
A person can speak loudly, quickly and with absolute certainty...
…and still be wrong.
You don’t have to become louder or tougher to hold your own.

Sometimes confidence is simply staying calm enough not to let someone else’s confidence become your decision.

Been told “the inheritance is almost sorted” for months?
Don’t just keep asking: “When will we get the money?”

Ask these 3 questions:

1. Has the executor submitted the L&D account that determines distribution of the assets?
For larger estates, this account reflects the assets, debts and how what is left will be divided.
And here’s something many families don’t know:
Once the account is approved by the Master of the High Court, the account lies open for inspection for 21 days. Interested parties can inspect it and object if they believe something is wrong.

2. What EXACTLY is causing a delay?
“The estate isn’t finalised yet” doesn’t tell you much.
Are we waiting for the Master? SARS? A property to sell? Money owed to the estate? Missing documents? A dispute?
There may be a perfectly good reason for a delay — but you can still ask what that reason is.

3. When was the executor appointed?
An executor generally has 6 months from appointment to submit the Liquidation and Distribution account to the Master.
That does NOT mean you must receive your inheritance within six months. There are still steps afterwards.

But if you’ve heard “almost done” for months, ask:
When was the executor appointed? Has the account been submitted? What stage are we at?

Waiting doesn’t automatically mean something is wrong.
But “we’re busy with it” isn’t the same as knowing what is happening.

1. Being the one who wants the divorce does NOT automatically mean you get less.
You don’t lose your financial rights simply because you were the person who said, “I want out.”

2. “Out of community with accrual” doesn’t simply mean: you keep yours, I keep mine.
The accrual system ensures a fair division at dissolution of the marriage.

3. Don’t forget about the pension.
People often think: “It’s their pension. I can’t touch it.”
Depending on how you’re married and the exclusions in an antenuptial contract, one spouse may have a claim against the other’s pension fund.

4. An inheritance isn’t automatically shared under accrual.
If your aunt leaves you R500 000 during your marriage, it is generally excluded from the accrual calculation — unless your antenuptial contract or the person who left it to you determined otherwise.

5. Worried that money or assets might suddenly “disappear”? Don’t ignore it.
If you’re married with accrual and your spouse starts moving or getting rid of assets in a way that could seriously affect your claim, there may be legal steps available.

So before you say:
“I don’t want anything. I just want the divorce over with.”
First find out what “anything” actually includes.

Don’t accidentally walk away from something you were entitled to!

Thinking about divorce? Contact Jacky Venter Inc before agreeing to what happens to the money, property or other assets.

Starting again can sometimes feel like going backwards.

A new job.
A new home.
A relationship ending.
A business changing.
A plan that didn’t work.

It can feel like you’re back at the beginning.

You’re not.

You’re starting with everything you know now that you didn’t know before.

Sometimes a new beginning is exactly what moving forward looks like.

There are times when you need clarity, not commentary.

No group chat.
No family opinions.
No friend-of-a-friend who “knows someone who went through the same thing.”

Just a private conversation where you can say what you need to say, ask what you need to ask, and understand where you stand.

Because sometimes you need advice, not an audience.

If you’d rather talk it through privately, our team is just a call away.
