What an incredible morning! The Araujo Attorneys joined forces with the Robin Hood Foundation for their Sarmie Army initiative at Crusaders and the amazing crew from Tyson Umhlanga, alongside volunteers across Durban North, to make 1800 sandwiches for the Domino Foundation to help feed underprivileged children at schools in our local North Durban community.

Seeing everyone pitch in - cutting, spreading, wrapping, and laughing - was a reminder of what community is all about. Small acts, big impact.

Yes — a child under the age of 18 can legally inherit a house, flat, land, or even a farm. However, there are important legal protections and processes involved when immovable property is inherited by a minor.

Property can be inherited through a Will, intestate succession, or a trust arrangement.

Although the property may be registered in the minor’s name, the child cannot legally manage the property themselves until they reach majority age. A parent, legal guardian, or trustee will usually manage the property on the child’s behalf and attend to matters such as maintenance, rates, levies, insurance, and rental income.

Importantly, immovable property belonging to a minor cannot simply be sold without oversight. Depending on the circumstances, approval from the Master of the High Court or even the High Court may be required to protect the child’s interests.

This is why proper estate planning is so important. A well-drafted Will and the correct legal structure can help avoid unnecessary delays, disputes, and complications for your loved ones in the future.
