Home Affairs’ special registration period for qualifying unregistered customary marriages closes on 31 August 2026.

Registration provides evidence of the marriage and can help protect spouses’ rights. Lobola may also be important evidence, but whether an otherwise valid customary marriage exists depends on the facts, the applicable custom and the available proof.

In VVC v JRM [2026] ZACC 2, the Constitutional Court confirmed that an antenuptial contract signed after a valid customary marriage already exists cannot, by itself, change the matrimonial property regime.
