KISCH IP was honoured to participate in the North-West University (NWU) World Intellectual Property Day 2026 webinar held on 20 May 2026 under this year’s global theme: “IP and Sports: Ready, Set, Innovate.”

Representing KISCH IP, Ursula Baravalle and Sarah Suleman presented on the role of intellectual property in sport and health innovation, focusing on how IP rights help innovators protect and commercialise new technologies, brands, and ideas within the sports sector.

We thank the Technology Transfer and Innovation Support (TTIS) team and the Physical Activity, Sport and Recreation (PhASRec) research entity within the Faculty of Health Sciences at North-West University for hosting an insightful and engaging webinar and for the opportunity to contribute to the broader discussion around innovation, research commercialisation, and intellectual property protection. The Promotion of Access to Information Act (“PAIA”), No 2 of 2000, gives effect to the constitutional right of access to any information held by the State and any information that is held by another person (including private companies) and that is required for the exercise or protection of any rights. PAIA gives the requester the right to lodge a request with the information officer of a public or private body. PAIA requires all private and public bodies to prepare a PAIA manual.

Exemptions - lapsed

There have been various exemptions for certain private companies to compile a manual. All exemptions have now come to an end and all private and public bodies now need to prepare a PAIA manual, appoint an Information Officer and annually file their PAIA report with the Information Regulator.

INTA 2026 has once again been a reminder of how connected the global IP community truly is.

From insightful discussions at the conference to spontaneous catch-ups across London outside the scheduled conference events, this week has provided the KISCH IP team with exceptional opportunities to reconnect with colleagues, build new relationships, strengthen existing ones, and engage with friends and peers from around the world.

Beyond the conference halls, London has provided the backdrop for many meaningful conversations shared over coffee, at receptions, and between meetings throughout the city.

It has been a fantastic week for the KISCH IP team, and we are grateful for the opportunity to spend time with clients, colleagues, and friends from across the international IP community.

On 15 April 2026, the new regulations to the Consumer Protection Act came into effect. These Regulations fundamentally change how unsolicited electronic marketing, such as spam calls, SMSs, and digital platform messages, are regulated under the CPA.

At the centre of the new framework is a National Consumer Commission (NCC) administered opt-out registry, which replaces the fragmented, marketer-by-marketer opt-out approach previously in place. Consumers can now register a pre-emptive block on a single, central registry to prevent unwanted electronic communications from all direct marketers, rather than having to opt out individually from each one.

The Regulations were issued by the Minister of Trade, Industry and Competition under section 120(1)(a), read with section 11(6), of the CPA, following consultation with the NCC and provincial consumer authorities. They amend the Consumer Protection Act Regulations, 2011 by providing the necessary prescribed forms and tariff schedules required to operate a functional registration and opt-out system. Importantly, the Regulations state expressly that they take effect on publication, being 15 April 2026, meaning the compliance obligations are already mandatory.

A key innovation is the introduction of new, clearly defined concepts that convert consumer rights into operational duties.

Hashiem brings extensive experience in anti-counterfeiting enforcement, brand protection, trade mark protection, and IP litigation, with a strong background in both civil and criminal enforcement relating to counterfeit goods.

His appointment strengthens KISCH IP’s anti-counterfeiting capabilities across the African continent, supporting clients in protecting their brands, disrupting illicit trade, and responding strategically to the complex enforcement challenges posed by counterfeit goods.

Kevin Dam represented KISCH IP at the Licensing Executives Society International (LESI) 2026 Annual Conference in Dublin, engaging in global IP discussions on licensing and innovation.

This year’s conference brought together leading voices from across the intellectual property and licensing community to explore the evolving role of IP in a rapidly changing landscape. Discussions ranged from AI-driven innovation to cross-border IP strategy and emerging technology licensing, highlighting both the challenges and opportunities shaping the future of the profession.

A key insight from the conference is that AI and emerging technologies are reshaping industries and redefining traditional IP frameworks. This calls for more agile, globally aligned strategies that balance protection with collaboration and commercialisation.

A new set of regulations has been published under the Agricultural Product Standards Act governing the classification, packing, and marking of mayonnaise, salad cream, salad dressing, and salad oil dressing intended for sale in the Republic of South Africa.

The regulations are scheduled to come into operation 12 months from the date of publication, namely on 24 April 2027. This transitional period affords affected stakeholders an opportunity to align their products and labelling practices with the revised legal requirements.

Manufacturers, distributors, and other stakeholders should act promptly to review their compliance with the new requirements in order to minimise potential regulatory exposure and commercial risk.
