Esterhuyse Greyling Incorporated (also known as EGI attorneys) was established on the 29th of March 2010 and carries on business in Rustenburg, North West. The firm has a dynamic team which comprises of two directors and one professional assistant. Meet our team:
Sjanie Esterhuyse
Sjanie completed her BA, LLB and LLM degrees at the North-West University, Potchefstroom (formerly the PU for CHE) in 2004. She started her articles at the Potchefstroom Legal Aid Board in 2003 and completed it at the firm Breytenbach Prinsloo after she relocated to Rustenburg in 2004. After being admitted as attorney in the High Court of South Africa on 23 May 2005 Sjanie continued her legal career at Breytenbach Prinsloo as professional assistant and head of the firm’s third party - and debt collection departments. In March 2008 she became a director at the firm Edward Leonard Ndzabandzaba (previously known as Breytenbach Prinsloo) and on 29 March 2010 she founded the firm Esterhuyse Greyling with Madelein Greyling. During her service at the abovementioned firms, she gained extensive experience in the following areas of the law, namely -:

Madelein Greyling

Madelein completed her B.Com and LL.B degrees at the University of the Free State in 1998. She served her articles at the firm Vorster & Partners in Bloemfontein, during 1996 to 1998. After being admitted in the High Court of South Africa as attorney, conveyancer and notary during 1999, Madelein joined the firm Van den Berg & Levin where she was appointed as professional assistant and head of the firm's conveyancing department. During 2000 she relocated to Rustenburg where she has been practicing as conveyancer for the past seventeen years. During 2002 Madelein joined the firm Breytenbach Prinsloo and became a director of the firm now known as Edward Leonard Ndzabandzana. On 29 March 2010 she founded the firm Esterhuyse Greyling with Sjanie Esterhuyse. During her legal career she gained extensive experience in the following areas of the law, namely -:

Both our Rustenburg and Koster offices are easily accessible to the public. Our Rustenburg office is situated at 194 K**k Street, ZZQ Building, on the corner of K**k- and Unie Streets, Rustenburg. Our Koster office is situated at 1 Brink Street in the Koster CBD area. We keep regular office hours from 08:00 to 16:30 from Monday to Thursday, and Fridays from 08:00 to 16:00. BEE – Status

Dienskontrakte wat sê die Wet?
Die Wet op Basiese Diensvoorwaardes (artikel 29) bepaal dat elke werknemer van skriftelike besonderhede rakende sy diensvoorwaardes voorsien moet word, by aanvang van sy indiensneming. Werkgewers kan reeds aan die verkeerde kant van die reg wees deur ‘n blote versuim om werknemers met sodanige skriftelike besonderhede te voorsien. Die kommissaris by die KVMA (CCMA) sal in alle waarskynlikheid reeds 'n negatiewe houding inneem teenoor ‘n werkgewer wat nie eers die Wet op Basiese Diensvoorwardes nakom nie. Dit is dus van uiterste belang dat werkgewers vanuit die staanspoor moet toesien dat daar aan al die vereistes soos vervat in die Wet op Basiese Diensvoorwaardes voldoen word.

“PAIA” - Wat’s dit??

In die nuus en op die sosiale netwerk hoor en lees ons almal van “PAIA”. Wat is “PAIA”? “PAIA” is Die Wet op Bevordering van Toegang tot Inligting, No. 2 van 2000 Dit is nasionale wetgewing wat verorden is om gevolg te gee aan die grondwetlike reg van toegang tot inligting.

Eskom dreig om elektrisiteit toevoer van verskeie munisipaliteite te sny weens miljoen erande se skuld. Wat staan die gemeenskap te doen? Munisipale kostes is betaal deur die verbruiker, en die vraag bly steeds hoekom moet ek as verbruiker ly as gevolg van die onbekwaamdheid van die munisipaliteit? Daar is verskeie vrae wat die gemeenskap vra:
1. Hoekom het die Stadsraad nie vir Eskom betaal nie?
2. Hoekom het Eskom nie dadelik opgetree toe die munisipaliteit versium het om hulle rekening te betaal nie?
3. Hoekom het die dorp nie lopende water nie?

Artikel 32(1)(a) van die Grondwet van die Republiek van Suid-Afrika, No. 108 van 1996 (hierna genoem "die Grondwet") bepaal dat almal 'n reg van toegang het tot enige inligting wat deur die staat gehou word en tot enige inligting wat deur 'n ander persoon gehou word wat vir die uitoefening of beskerming van enige regte benodig word.

PAIA gee die verbruiker toegang tot inligting om redes aan te vrae van staatsdepartemente, maar kan ook gebruik word om inligting vanaf privaat instansies (soos maatskappye en beslote korporasies) te bekom. As verbruiker het jy die reg om inligting aan te vra soos: Hoekom word my bestuurs- / vuurwapen lisensie afgekeur? Dit is noodsaaklik om inligting te bekom, veral as dit jou benadeel, sodat jy die nodige inligting het om nie weer dieselfde fout te maak nie.

Hoe rig ek as verbruiker ‘n versoek?
'n Versoek om toegang tot 'n rekord word gerig deur 'n versoekvorm genaamd Vorm A vir openbare liggame in te vul. Welke vorm by die kantoor vir menseregte kommissie is.Die versoekvorms moet ingevul en ingedien word by die inligtingsbeampte van die openbare liggaam. Dit kan tussen 30 en 90 dae duur om op die versoek te reageer.

Vereistes en prosedures?
‘n Versoek wat gerig word moet in skrif wees. Dit moet redes versoek oor die betrokke besluit wat geneem was deur die staatsdepartement en die verbruiker moet ook redes aanvoer oor hoekom die beslissing verkeerd is. Volgens PAIA moet redes versoek word binne 90 dae nadat die besluit aan die verbruiker bekend gemaak is. As die betrokke staatsdepartement ‘n antwoord op die versoek om redes gee, moet dit ‘n skriftlike antwoord wees. As u nie tevrede is met die antwoord wat aan u verskaf is nie, het u die reg om intern te appeleer, maar let daarop dat nie alle departemente interne prosedures het nie. (Die department van Binnelandse-Sake het wel ‘n interne prosedure). Die aansoek om te appeleer teen die besluit van die staatsdepartement moet binne 180dae gebring word.

Dit is belangrik dat ons as verbruikers nie net terugsit en besluite aanvaar nie. Staan op u regte, versoek redes.
