Did You Know?

In medieval England, people accused of crimes could face something called a trial by ordeal. This meant they were put through painful tests — like holding hot iron or being placed in water — because it was believed that God would decide whether they were innocent or guilty.

Thankfully, the law has come a long way since then! Modern legal systems rely on evidence, fairness, and proper legal procedures instead of physical ordeals.

Learning about the history of law reminds us how important fairness and justice are today — and how legal systems continue to evolve over time.

At Grobler Malope Inc, we enjoy sharing interesting legal facts and helping people better understand the law.

Burden of Proof

Have you ever wondered why the level of proof differs between criminal and civil cases? The answer lies in something called the burden of proof — the standard the court uses to decide whether a case has been proven.

1) Criminal Cases –> Beyond Reasonable Doubt
In criminal matters, the court requires very strong proof before finding someone guilty. The evidence must leave no reasonable doubt, because criminal cases can lead to serious consequences such as fines or imprisonment.

2) Civil Cases –> Balance of Probabilities
In civil disputes, the court asks a different question: which version is more likely to be true? If one side’s evidence is more probable than the other’s, the court may rule in their favour.

These different standards help ensure fairness, depending on the nature of the case and what is at stake.

Would you rather be…?

Legally correct & morally wrong OR Morally right, but legally incorrect?

Sometimes the law and our personal sense of right and wrong don’t perfectly align. The law sets clear rules to keep society fair and consistent — but people’s moral beliefs can be very different from one another.

Being legally correct can protect you from consequences, but it doesn’t always feel right emotionally. On the other hand, doing what feels morally right might come from good intentions, yet still lead to legal problems.

There isn’t always a simple answer — and that’s what makes these conversations so interesting.

At Grobler Malope Inc, we believe open discussions help people better understand the role of law in everyday life.

Know Your Rights | If You Are Arrested

Many people are unsure about what their rights are when they are arrested. The South African Constitution protects every citizen by ensuring that certain rights must be respected during an arrest.

Here are three important rights to remember:

1️⃣ The Right to Remain Silent
You do not have to answer questions or make statements that could be used against you. Staying silent is a legal right — not an admission of guilt.

2️⃣ The Right to Be Told Why You Are Being Arrested
You must be informed of the reason for your arrest so that you understand what is happening and why.

3️⃣ The Right to Legal Representation
You are entitled to speak to a lawyer and receive legal advice. Legal guidance helps protect your rights and ensures you understand the process.

Knowing your rights helps you stay calm, informed, and protected during stressful situations. At Grobler Malope Inc, we believe legal knowledge should be accessible to everyone.

Did you Know?

Before recording devices were used in courtrooms, court reporters had to be highly skilled in shorthand — a special writing system that used symbols to quickly capture words and sounds so that every detail of court proceedings could be recorded accurately.

It’s interesting to think how much dedication and skill was required to keep accurate court records long before modern technology. Even today, accurate records remain one of the most important parts of ensuring fairness and accountability in the legal system.

The law continues to evolve with technology, but the goal stays the same — making sure every voice is properly recorded and every process is fair.

At Grobler Malope Inc, we enjoy sharing practical and interesting legal facts to help make the legal world easier to understand.

What you can use as evidence in court?

Many people don’t realise that evidence in court is not limited to formal documents — everyday records can sometimes play an important role in supporting your side of a story.

Here are a few common examples:

✔ Testimony from key witnesses – people who personally saw or heard what happened.
✔ Photo albums or photos – pictures can help show what happened or when it happened.
✔ Notes & journals – written records made at the time can help explain events or timelines.
✔ Calendars – appointments and date records may help confirm important details.

Every legal matter is different, and whether something is accepted as evidence depends on the circumstances and legal rules. The important takeaway? Keep good records and preserve information whenever possible.
