May I have an Attorney prepare an eviction application and evict the tenant from a property?

Yes. ‼‼

An Attorney may prepare, serve and even be granted an Order for the Eviction of a tenant from a premises during Alert Level 4. The Order may however only be executed after Alert Level 4 ends.
It is important to understand the difference between the 'ex*****on of an eviction order' and the 'granting of an eviction order' under Level 4 Lockdown:

The Minister has stated that no person may be evicted during level 4. This is correct and this is what is considered to be an ex*****on of an eviction order.

No eviction order can be executed on until such time as the lockdown has been relaxed further and the regulations allow it.

In the interim though, landlords are entitled to consult with eviction attorneys, prepare their applications for eviction and approach the courts to have their eviction order granted. It is at this stage that they are then required to pause the process until such time as tenants are allowed to move their items and the order can be carried out by a sheriff if the tenant unlawfully refuses to leave the premises.

If you are unable to pay your rent, consult with the agent and landlord and agree on the way forward by concluding a deferment agreement.

Failure to resolve contractual obligations will result in eviction by die landlord

This tenant occupied a property without paying a deposit and has a current outstanding balance of R14015.10, due to Ugandree Gobin fraudulently allocating payments to the rental statement that is not reflecting on the bank statement.

This individual has also made threats to the property owner and their representatives.

Please be aware of this individual, who is currently in the market for property.

The above individuals fraudulently rented a property and failed to pay a deposit as well as one months rental and fees.

Further to the above, these individuals, who are trading as maintenance contractors, stripped the rental property from pipes and fittings.

Because if threads made to the agent reporting on the 2 individuals that is posing as purchasers and then stealing valuables from homes we had to consider the implication to the agent and had to remove the post... very sad... that criminals have such an influence on society..

Please be advised that Mr Raymond Steenkamp ID number 720910 5269088 has been added to the list of defaulted tenants for non-payment of rental for 6 months and is in arrears with R 80 061.99.

The municipality also advised us that he had tampered with the electricity meter.

Please be on the look out for him

I trust that you had a wonderful weekend.

I was informed by my principal to send out important correspondence in regards to one of our tenants that recently vacated a property that we are renting out. Please be aware that this tenant has failed to pay 3 month’s rental, always a different excuse. She entered an agreement with us, the agreement was in the name of a business. She has been subletting, failing to settle rental and withholding money as she pleases for water, repairs etc.

Elrica Fourie Verreyne WARNING!!!!! PLS DO NOT HAVE ANY DEALINGS R3,000 — Richards Bay, KwaZulu-Natal WITH DURAN AND ANGELA GROENEWALT We had a contract with them to rent a flat in there yard, paid them the full amount of R3000 for the months rent of march, they lied and deceived us and ran away with our money! They moved out of the house, the same day we moved into the flat. The property didnt belong to them and the rightful owner now asked us to move out, after moving in here for 4 days! PLS HELP US!!!!!!! We have no where to go and are URGENTLY looking for a one or two bedroom flat!
