Through respectful engagement and a commitment to doing what is right, outcomes were reached that serve the best interests of those who depend on the system most. Accountability was taken where it was due, and clarity was provided where it was needed, allowing for resolutions that are both fair and sustainable.

The "Lawyer’s Letter" vs. The Law: Can you unilaterally suspend contact?
It’s a trend that’s becoming all too common in South African family law:

A formal letter arrives from a colleague "summarily suspending" or "varying" a parent’s contact based on a list of allegations.

While these letters often sound authoritative and dripping with legal jargon and "urgent" warnings there’s a fundamental reality we need to address.

A lawyer's letter is not a Court Order and I fail to understand why some colleagues feel that it functions as such.

In South Africa, the Children’s Act 38 of 2005 is the north star for parental rights and responsibilities.

Under Section 35, it is actually a criminal offense to prevent a parent from exercising their court-ordered contact without a "good cause."

Taking the law into your own hands by unilaterally cutting off a parent (often referred to as "self-help")is something our High Courts look upon with extreme displeasure.

We have to be honest here. There is a massive difference between:

A Real Risk:

Evidence of physical abuse, substance-induced danger, or immediate harm.

Alienation:

Using the legal process to alienate or punish a co-parent for personal grievances.

If there is a genuine, evidence-backed risk, the correct path isn't just a sternly worded letter; it's an urgent application to court or a referral to a social worker for supervised contact.

Suspending contact via a letter and then "waiting to see" is often the first step in a campaign of parental alienation, which does more damage to the child than the alleged "risk" ever would.

If you are the parent sending that letter, be careful. If the matter reaches a judge, you may find yourself facing:

Punitive Cost Orders:

The court may order you to pay the other side’s legal fees.

Contempt of Court:

If a valid court order or parenting plan was already in place.

Negative Credibility:

Judges are increasingly savvy at spotting gatekeeping behavior early in a case. And sometimes they miss it entirely - making orders that fundementally assist the alienator.

A Note to My Colleagues:

Advocacy doesn't mean being a mouthpiece for a client's frustrations. Our duty is to the best interests of the child. If we are assisting in cutting off a parent without a rock-solid, urgent reason, we aren't protecting the child we’re participating in the litigation of their childhood.

During a function I recently attended, the question posed to us was: What colour would you use to describe your 2025 and why this specific colour?

I have chosen the colour red šŸ’

For me, red is a bold colour, a vibrant colour, a colour that stands out, commands attention and symbolises strength and courage. This year we had to step into boldness. We were in positions where we had to push ourselves beyond our comfort zones, we had to take risks and we had to make decisions that challenged us. Just like the colour red, this year was intense, energising and full of moments that reminded me of what we are capable of.

1. This year, I truly stepped out of my comfort zone when I attended to bail applications, something I never imagined myself doing before. Taking on these experiences required confidence, courage and a willingness to grow. It was a bold move and looking back I am proud of how these moments pushed me forward and contributed to my personal and professional growth

2. I also had the incredible privilege of being a panelist speaker at this year's SACBW National Summit. What an honour it was to stand before more than 150 inspiring women and share knowledge, experiences, and insights. Being able to contribute to their growth and empowerment was truly rewarding and it reminded me how meaningful it is to use your voice to uplift others.

3. My husband and I spent many beautiful hours training together for the Cape Town Marathon. Even though the final outcome wasn't quite what we had envisioned, the journey itself was incredibly meaningful. Through every early morning run and every long -distance session, I was reminded of how grateful I am for what our bodies are capable of. Training for a marathon taught me resilience, patience and appreciation

4. Another highlight of this year was seeing a matter we were involved in published on SAFLII. Having our work reflected on such a respected legal platform was both rewarding and affirming. It served as a reminder of the significance of the work we do and the impact it can have within the broader legal community

5. Our Debt Collection department has grown exceptionally this year. Stronger, sharper and more efficient than ever before. This remarkable growth didn't happen by chance, it happened because of Justine van Rensburg . Her dedication, precision and unwavering commitment have been the driving force behind our success.

6. Another beautiful moment from this year was seeing my husband's dream come true - competing in the Joburg Ride with his son. Watching the two of them share this experience, doing something they both love, was incredibly special. It was more than just a ride, it was a memory they will carry forever and witnessing it filled my heart with pride and gratitude

7. Together with the dedicated committee members of the Gauteng, West Rand Branch, we hosted the most beautiful Breast Cancer Awareness function. It was an event filled with purpose, compassion and unity, where every detail, every conversation and every shared moment carried deep meaning. Standing together to honour survivors, support fighters and raise awareness reminded us of the power of community and the strength that comes from women uplifting one another

8. And amid all the milestones and memorable moments, we also made beautiful friends this year. Connections formed naturally, laughter was shared and new bonds were built that added even more warmth and joy to our journey. These friendships have truly been one of the year's greatest gifts.

2025 was a year of resilience, strength and growth, a year that will be remembered for the challenges we overcame and the milestones we achieved.

The Children’s Court:

⭐ Determines if a child is in need of care and
protection

⭐Make orders to protect the child

⭐ Handle matters about parental responsibilities and rights

⭐ Focus on the best interest of the minor child

A Children's Court is more informal, child-friendly and it is a more supportive environment than ordinary courts. The goal is to make proceedings non-intimidating and sensitive to the child’s needs.
