🏡 Thinking of Buying or Selling a Home? Pelser Attorneys Handles Your Entire Property Transfer! ⚖️

At Pelser Attorneys, we specialise in all types of property transfers (conveyancing) — from standard transfers to township registrations. Our team ensures the process is smooth, transparent, and handled with the highest level of professionalism.

🔍 How the Home Transfer Process Works in South Africa

1️⃣ Offer to Purchase Signed
The transfer process begins once the buyer and seller signs a binding Offer to Purchase (OTP).

2️⃣ Appointment of the Conveyancer
In South Africa, the seller normally appoints the transferring attorney, while the buyer pays the transfer costs.

3️⃣ F**A & Document Collection
Both parties provide ID documents, proof of address, marital status details and other required documents to comply with F**A. Missing documents cause delays.

4️⃣ Bond Registration & Bond Cancellation
If the buyer needs a home loan, the bank appoints bond attorneys. If the seller has an existing bond, cancellation attorneys are appointed. As transferring attorneys, we liaise with these separate attorneys and ensure that all parties lodge and register simultaneously.

5️⃣ Rates Clearance Certificates
We obtain municipal clearance certificates to confirm all rates and taxes are paid up before transfer.

6️⃣ Signing of Transfer Documents
Buyer and seller sign the required documents at our offices.

7️⃣ Transfer Duty & Financial Requirements
The buyer pays transfer duty to SARS (unless VAT applies) through our offices. This must be done before lodgement.

8️⃣ Lodgement at the Deeds Office
All documents — transfer, bond registration, and bond cancellation — are lodged together at the Deeds Office.

9️⃣ Registration Day
Once approved and registered, the property officially transfers into the buyer's name. Congratulations — ownership is complete! 🎉

🌍 BUYING A HOUSE: WHAT COSTS WILL YOU PAY, AND WHEN? 🏡
“It is a comfortable feeling to know that you stand on your own ground. Land is about the only thing that can’t fly away.” – Anthony Trollope

With home loan rates at their lowest since 2022 and property market confidence hitting a record 87% at the end of 2025, South Africa’s housing market is buzzing. Budget 2026 has only added to the excitement, boosting affordability and stimulating sales.
But before you put in that offer on your dream home, remember: the purchase price isn’t the only cost you’ll face. Without careful budgeting, unexpected expenses can derail your plans — or even put your sale at risk.

💡 HERE’S A QUICK CHECKLIST OF COSTS TO PLAN FOR:
✅ COSTS BEFORE TRANSFER
- Deposit (usually 5–10% of the purchase price)
- Bond initiation fee (often includes valuation)
- Insurance premiums (homeowner’s & life cover if required)
- Balance of purchase price (if not covered by deposit + bond)
- Transfer duty (government tax on properties over R1,210,000)
- Transfer attorney fees & disbursements
- Bond registration fees & Deeds Office charges
- Rates & levy clearance certificates
- Occupational interest (if you move in early)
- Utility deposits
- Moving costs

📅 ONGOING MONTHLY COSTS AFTER TRANSFER
- Bond instalments
- Municipal rates & taxes
- Levies (if sectional title/HOA)
- Utilities
- Insurance premiums

🛠️ ONE-OFF COSTS AFTER TRANSFER
- Renovations, repairs, redecorating, garden upgrades
- Furniture replacements
- Long-term maintenance

🔑 THE TAKEAWAY: Plan ahead, budget smartly, and avoid unpleasant surprises. With a clear cash flow forecast, you’ll know exactly what you can afford — and when payments are due.
At Pelser Attorneys, we’re here to guide you through the legal and financial steps of property transfers, so you can focus on turning your new house into a home.

📘 Weekly Legal Insight: Antenuptial Contracts
Many couples plan their wedding day with great care—but forget to plan for their financial future.
An antenuptial contract (ANC) is a legal agreement entered into before marriage that determines how assets and debts will be handled during the marriage and in the event of divorce or death.

✅ Why consider an Antenuptial Contract?
Protects individual assets
Clarifies financial responsibilities
Prevents costly disputes later on
Offers certainty and peace of mind
In South Africa, if you marry without an antenuptial contract, you are automatically married in community of property, which may not suit everyone’s circumstances.
At Pelser Attorneys, we guide you through the process with clarity and discretion—ensuring your agreement is tailored to your needs and legally sound.
