Under section 37C of the Pension Funds Act 24 of 1956, retirement fund death benefits generally do not form part of a deceased member’s estate and are not strictly governed by their Will. The fund’s trustees determine the distribution in accordance with the law.

A nomination does not replace a Will. Your Will and beneficiary nominations should work together to ensure your intentions are properly considered.

Estate planning isn’t only about deciding who inherits. Your estate must also have sufficient liquidity to settle debts, taxes, and administration costs.

Without proper planning, assets intended for your beneficiaries may have to be sold to meet these obligations.
