Cybercrime is no longer a niche concern. South Africans use online services for banking, contracts, shopping, business and personal communication, making questions about fraud, privacy and digital evidence increasingly relevant.

South African law criminalises various forms of cyber-related conduct, while POPIA regulates how organisations must protect personal information and respond when that information is compromised.

What happens if your personal information is exposed? What can you do if you are a victim of online fraud or identity theft? Can messages, emails and other electronic records be used as evidence?

The answer will depend on whether the matter involves a crime, a data breach, a contractual dispute or a combination of different legal issues.

Have you been affected by online fraud, identity theft, a data breach or another digital legal matter?

South Africa’s courts are gradually adopting digital tools. In the High Courts, Court Online supports electronic filing, digital case management and the management of court evidence.

However, the shift is not the same across every court. What can be filed or handled online still depends on the court, the division, the type of matter and the rules that apply.

Electronic documents may also carry legal weight, but that does not mean every digital document automatically meets the necessary requirements. Its format, signature, authenticity and the way it was submitted can still matter.

At Andrea Krüss Attorneys, we guide our clients through both the legal substance of their matter and the process involved, step by step and in plain language.

Financial distress does not automatically mean that a business must close its doors.

Where a company is financially distressed and there is a reasonable prospect of rescuing it, business rescue may provide a structured opportunity to rehabilitate or restructure the company.

In some cases, the process may also aim to achieve a better return for creditors or shareholders than immediate liquidation would provide.

Liquidation may be the more appropriate route where recovery is no longer reasonably possible.

The correct option depends on the company’s finances, assets, liabilities and realistic prospects of rehabilitation.

A maintenance order is a binding court order.

When maintenance is not paid, it can place significant financial pressure on the person responsible for caring for the child. It may also lead to enforcement proceedings and further legal consequences.

A maintenance amount may need to be reconsidered when circumstances change, such as a loss of income, increased school fees or changes in a child’s needs.

Until an order is formally varied by the court, the existing order remains in effect.

Trust assets do not automatically form part of either spouse’s personal estate.

However, in certain divorce or accrual disputes, a court may consider how a trust has been controlled or used, particularly where there is evidence that it operated as one spouse’s alter ego or was used to frustrate a legitimate financial claim.

The trust deed, appointment of trustees, financial records and the separation between personal and trust assets may all become relevant.

Every matter depends on the matrimonial property regime, the relief being claimed and the evidence before the court.

When spouses are married in-community of property, their estates generally form one joint estate.

During divorce proceedings, the division of that estate must be properly addressed. However, the practical winding-up, valuation and transfer of assets may continue after the divorce order has been granted.

Property, debt, pension interests and business interests may all form part of the discussion, which is why it is important to obtain legal advice before signing a settlement agreement.
