Can My Employer Dismiss Me Without a Hearing?
In South Africa, employees have the right to a fair hearing before dismissal.
An employer cannot legally terminate your employment without following a fair procedure, except in very limited cases of gross misconduct where immediate action is justified.
The Labour Relations Act requires that dismissal be both substantively and procedurally fair.
If you believe you were dismissed unfairly, you can challenge the dismissal at the Commission for Conciliation, Mediation & Arbitration (CCMA) or in the Labour Court.
