What is Business Rescue?

Business Rescue is a legal process under Chapter 6 of the Companies Act 71 of 2008. It helps financially distressed companies restructure their business, property, and debts to :

✅ Return the company to solvency and keep trading; or

✅ Give creditors a better outcome than immediate liquidation

How It Works?

1. A Business Rescue Practitioner takes temporary control of the company

2. The institution of legal actions by creditors are put on a temporary hold (moratorium) to provide some breathing space

3. The Business Rescue Practitioner assesses the company and creates a Business Rescue Plan for the approval of all creditors.

4. Creditors vote on the plan, and if approved, the company can restructure, sell assets, or negotiate debts while continuing operations.
