🔴 Constitutional Court — Loss of Citizenship Declared Unlawful

The Constitutional Court has confirmed that South Africans do NOT automatically lose their citizenship when they voluntarily acquire foreign nationality.

👉 The impugned provision of the South African Citizenship Act was declared unconstitutional.
👉 Thousands of South Africans living abroad are now legally recognised as full citizens again.
👉 The judgment restores dignity, political rights, and constitutional belonging.

📌 Why this matters:
This is a hard reset on how the state treats citizenship. Administrative convenience lost. Constitutional supremacy won. Home Affairs must now align its systems — failure to do so invites review applications, damages claims, and further litigation.

⚖️ What’s happening

Mike Sandlana (IPHC Jerusalema faction leader) has been denied bail by the Pretoria Specialised Commercial Crimes Court and will remain in custody.

The case ties to allegations that Sandlana and Vusi Ndala (IPHC spokesperson) paid about R2.4 million to/for the benefit of Gauteng High Court Judge Portia Phahlane (and linked parties), allegedly to influence outcomes in a long-running IPHC succession dispute.

📌 Court’s bail findings (high-level)

The court recorded concerns around risk factors (including flight risk and witness intimidation/threat allegations) when refusing bail.

Co-accused (including Judge Phahlane, her son Kagiso Phahlane, and Vusi Ndala) are already out on bail (with conditions).

🗓️ Next milestone

The matter has been postponed to 6 March 2026 (for further investigation / alignment with co-accused’s matter).

💡 Why this matters (my blunt take)
This isn’t gossip—it’s a reputation-risk event for the justice system. When bribery allegations orbit a sitting judge, the whole rule-of-law brand takes strain. The old foundations—procedural fairness, clean records, credible courts—are exactly what keep the system standing. And the court’s bail ruling signals: “We’re not gambling with integrity.”
