When parents separate, the question often becomes:

“Who gets the children this weekend?”

But good parenting arrangements need to go much further than weekends.

A properly considered parenting plan can address matters such as:

This surprises a lot of first-time buyers.

Buying property involves a process — and ownership of immovable property is registered through the Deeds Office.

Between signing the OTP and registration, there can be a considerable amount of work happening behind the scenes.

The conveyancer may need to deal with:

✔️ Bond registration

“HOW MUCH MAINTENANCE SHOULD I PAY?”

There isn't one magic number that applies to every child.

Child maintenance is based on the circumstances of the child and the parents.

Things such as the child's needs and the respective financial circumstances of the parents are relevant.

And maintenance isn't simply about groceries.

It can include expenses relating to:

🏠 Accommodation
🍎 Food
👕 Clothing
📚 Education
🏥 Medical needs
⚽ Activities
…and other reasonable needs.

The Department of Justice confirms that both parents have an obligation to contribute towards the needs of their child.

That means a maintenance discussion should be based on actual needs and actual financial circumstances, rather than:

“He earns more, so he must pay everything.”

or

“She earns a salary, so I don't have to contribute.”

Every family is different.

If you're negotiating maintenance, start with the numbers — not the argument.

🧐“BUT I BOUGHT IT VOETSTOOTS…”🏠

Three words that can cause a LOT of confusion in property disputes.

“Voetstoots” does not simply mean:

“The seller can never be held responsible for anything.”

The legal position surrounding defects in a property depends on the circumstances, the terms of the agreement, what was disclosed, what was known, and the nature of the defect.

And this is why a property inspection matters.

Before purchasing a property, look beyond the beautiful kitchen and the freshly painted walls.

Ask questions.

Inspect.

Get reports where appropriate.

Understand the agreement.

And keep written evidence of important representations made by the seller or agent.

Because discovering a serious defect AFTER registration can turn a dream home into a legal dispute very quickly.

If you have discovered defects after purchasing a property, don't assume that you have no legal recourse.

Get advice before confronting the seller or signing anything.

📑AN ANTENUPTIAL CONTRACT IS NOT A ROMANTIC CONVERSATION.

We know.

Talking about what happens to your assets if your marriage ends isn't exactly what most couples dream about while planning their wedding.

But an antenuptial contract is about more than divorce.

It determines the matrimonial property system that will apply to your marriage and can have significant consequences for your finances, assets and liabilities.

One of the most important things to understand is that:

“Out of community of property” does not automatically mean “without accrual”.

There are different matrimonial property consequences depending on what is agreed in the antenuptial contract.

And timing matters.

An antenuptial contract must generally be executed before the marriage and registered in the Deeds Registry to have the intended effect against third parties.

So please don't leave your ANC until the week before the wedding.

Your wedding date may be flexible.

Your legal options become considerably less flexible once you are already married.

⚖️“IF HE/SHE DOESN’T PAY MAINTENANCE, CAN I STOP CONTACT?”⚖️

This is a question we hear regularly.

The short answer is: maintenance and contact are separate issues.

A parent's failure to pay maintenance does not automatically mean that the parent loses the right to have contact with the child.

Likewise, having contact with a child does not mean that a parent is excused from their maintenance obligations.

Parental responsibilities and rights can include:

• Care of the child
• Contact with the child
• Guardianship
• Contributing towards the child's maintenance

The exact arrangements will depend on the circumstances of each family and, importantly, the best interests of the child.

If parents cannot agree on arrangements, a parenting plan can deal with issues such as where the child lives, contact, maintenance, schooling and other important matters.

The child should not become the battlefield between two adults.

Not quite.

Signing the Offer to Purchase is an important step — but the transfer of immovable property involves a legal process before ownership is registered in your name.

Depending on the transaction, there may be:

📌 Bond cancellation
📌 Transfer duty or VAT considerations
📌 F**A requirements
📌 Clearance certificates
📌 Municipal figures

And the property only becomes registered in the purchaser’s name once the transfer is registered in the Deeds Office.

Buying property is probably one of the biggest financial commitments most people will make.
