🚨 IMPORTANT RAF UPDATE 🚨

The Supreme Court of Appeal has ruled against the RAF’s stricter claim submission rules that caused thousands of claims to be rejected since 2022.

This means that people whose RAF claims were previously rejected because of “missing documents” or the new RAF1 form requirements may now get another opportunity to re-submit their claims before the end of September.

The RAF has confirmed that it will soon begin a communication campaign explaining how affected claimants can re-submit their claims.

If your claim was rejected or you are unsure about the status of your RAF matter, do not panic, our offices are closely following these developments and remain committed to assisting our clients every step of the way.

💡 A verbal agreement can be legally binding in South Africa, but proving it later can be harder than finding parking at the mall on payday.

Without written proof, it often becomes:
"But you said…" vs "No, you said…"

And unfortunately, courts prefer evidence, not memories.

Legal Tip: Silence can cost you more than words ever will!!!!!..

Picture this…

A certain gentleman,let’s call him Mr “I’ll deal with it later”,receives a formal notice. He reads it, sighs dramatically, and tells himself, “They’re probably bluffing.”

Days pass. Then more days. Emails come in. He ignores those too. Life continues… peacefully… until it doesn’t.

Next thing? There’s a default judgment against him. Now he’s shocked. Confused. Offended, even. “But no one told me it was serious!”

Oh, but they did.

Here’s the thing: in law, ignoring something doesn’t make it disappear,it usually makes it worse. Whether it’s a Notice to Defend, a Rule 41A Notice, or even a polite legal email… silence is often interpreted as non-compliance.

The lesson?
If you receive legal documents:

Read them properly (yes, all the pages).
Respond within the required time.
If you don’t understand then ask someone who does.
Because in law, “I thought it would go away” is not a defence… it’s a regret.

⚖️ BEFORE YOU SIGN THAT DOCUMENT… PLEASE BREATHE.

Whether it’s:
• An Acknowledgment of Debt
• A Settlement Agreement
• A Divorce Settlement
• A Loan Agreement
• An Employment Contract

Once you sign, the law generally assumes you understood what you were signing.

South African law doesn’t recognise:
❌ “I didn’t read it properly.”
❌ “I trusted him.”
❌ “I was in a rush.”
❌ “He said it’s just a formality.”

A signature is not decoration. It’s commitment.

We’ve seen it too many times someone signs under pressure, only to realise later that the “small clause at the bottom” is now a very big problem.

📌 Friendly advice:
If you wouldn’t click “Accept All” on a 40-page contract without reading it… don’t do it in real life either.
