If you've ever been involved in a personal injury or third-party claim, you've probably heard your attorney refer to the "quantum" of a matter. While the term sounds technical, its meaning is relatively straightforward.

In legal terms, quantum refers to the amount of damages or compensation to which a claimant is entitled once liability has been established. Put simply, it answers the question: How much is the claim worth?

This differs from the issue of liability, which determines who was responsible for causing the loss or injury. Once liability has been resolved, either through agreement or by a court, the focus shifts to quantum.

In Road Accident Fund claims, for example, quantum may include compensation for past and future medical expenses, loss of earnings or earning capacity, general damages for pain and suffering, and the cost of future care, where appropriate. Determining quantum often requires evidence from medical specialists, actuaries, occupational therapists, and industrial psychologists to accurately assess the claimant's losses.

Quantum is rarely a fixed figure. It is assessed according to the unique facts and circumstances of each case, considering both the evidence presented and previous court decisions involving comparable injuries. For this reason, two claims arising from seemingly similar accidents may result in significantly different awards.

Understanding the distinction between liability and quantum helps clients better appreciate the litigation process. Establishing fault is only the first step; determining fair compensation is often the more complex and contested aspect of a claim.

EXPLANATION OF COMMON LEGAL TERMS
LITIGATION

Litigation is a process that involves parties in a lawsuit. The purpose of the process is to try and resolve the dispute arising between the parties through the court system. The one party would have brought a legal claim against the other.

This process has different stages which can be outlined as follows:
* 𝗣𝗹𝗲𝗮𝗱𝗶𝗻𝗴𝘀 – this is the filing of the lawsuit by the complainant and affording the other party the opportunity to reply to the complaint or claim against him/her.
* 𝗗𝗶𝘀𝗰𝗼𝘃𝗲𝗿𝘆 – Exchanging documents, evidence, and any other information that is relevant to assist in the legal proceedings.
* 𝗣𝗿𝗲-𝘁𝗿𝗶𝗮𝗹 – A meeting held by the legal representatives of all parties in order to iron out certain issues before the matter can go to trial.
* 𝗦𝗲𝘁𝘁𝗹𝗲𝗺𝗲𝗻𝘁 𝗻𝗲𝗴𝗼𝘁𝗶𝗮𝘁𝗶𝗼𝗻𝘀 – Attempts to resolve the dispute without a trial.
* 𝗧𝗿𝗶𝗮𝗹 – The formal court proceeding in which the parties present evidence and arguments before a presiding officer in order to give a judgement regarding the disputes.
* 𝗝𝘂𝗱𝗴𝗺𝗲𝗻𝘁 – The decision made by the presiding officer which is normally referred to as the court's decision.
* 𝗔𝗽𝗽𝗲𝗮𝗹 – Requesting a review of the decision made by a higher court.
