When a court awards costs in a client's favour, that order is only the beginning of actually recovering money. What follows is a process called taxation, where a Taxing Master examines the bill of costs line by line to decide which charges were properly and necessarily incurred.

This is not a formality that a bill simply passes through. The Taxing Master can, and often does, reduce or strike out items that appear excessive or unnecessary, which means a carelessly drawn bill can result in a client recovering far less than the costs order seemed to promise. Once taxation is complete, the Taxing Master issues a certificate known as an allocatur, confirming the exact amount the other party must pay.

It is also worth knowing that appearing before a Taxing Master to argue a bill is generally reserved for admitted legal practitioners, which is one reason an attorney-backed cost consulting service can take a matter further than a costs consultant working alone.

A single law firm sometimes has more than one starting point. MacRobert Attorneys traces its history to three founding partners, Norman MacRobert, Frederick Lunnon and William Alfred Tindall, who began not as one firm but as two separate practices in Pretoria back in 1896.

The two practices ran alongside each other for close to a century before finally merging in 1989, and the resulting name, MacRobert, De Villiers, Lunnon & Tindall, proved such a challenge for clients to remember that it was shortened to simply MacRobert not long after. What has never changed is the throughline between those original partners and the firm operating today.

At the Pretoria office, consulting rooms still carry the founders' names, and old photographs and documents sit as a quiet reminder of where the firm began. Property owners and prospective buyers often use the terms "option to purchase" and "right of first refusal" as though they mean the same thing, but the two create very different obligations.

An option to purchase binds the owner to a specific offer, at an agreed price, for a set period, and the owner cannot withdraw or sell to anyone else while that option remains open. A right of first refusal works differently: the owner is never obliged to sell at all, but if they do decide to sell during the period the right applies, they must offer the property to the rights holder before approaching anyone else.

This distinction matters most when a deal falls through. A holder of an option can generally force the sale through on the agreed terms, while a holder of a right of first refusal can only insist on being given the first opportunity, at whatever price the owner is prepared to accept.

Recovering legal costs after a matter concludes should feel like the final, straightforward step. In practice, it is often where clients lose money they were entitled to recover, usually through mistakes made long before the bill of costs is even drawn up.

The most common pitfall is poor recordkeeping during the case itself: invoices and disbursement records that go missing make it far harder to justify a claim later. A close second is accepting a settlement offer without first establishing what costs are actually recoverable, which can mean giving up money that a properly drawn bill would have secured.

Timing matters just as much as accuracy. Bills of costs that are delayed too long become harder to substantiate, and opposing parties are quicker to dispute figures that arrive without clear supporting detail.

A sale can be fully signed and the purchase price fully secured, and a transfer can still stall over a single document: the Electrical Certificate of Compliance. South African law requires the seller to hand the purchaser a valid certificate before the Deeds Office will register the transfer, confirming that the property's electrical installation meets the required safety standard.

The certificate must come from a registered electrician and is only valid for two years, which means a certificate obtained early in a long sale process can expire before the transfer is finalised. Any electrical work carried out afterwards, however minor, can also invalidate it and trigger a fresh inspection.

Sellers who arrange this certificate well before listing a property, rather than waiting for the buyer's attorney to ask for it, tend to avoid the delays that catch so many transactions in the final stretch. Transferring ownership of a property in South Africa is not complete the moment a sale agreement is signed. Before a buyer becomes the registered owner, the transfer must be lodged and registered at the Deeds Office, a process that confirms the change of ownership in the public record and protects both parties against future disputes over title.

This process typically involves a conveyancing attorney preparing the necessary documents and settling any outstanding rates on the property, after which the transfer duty is calculated and paid before registration can proceed.
