Registering a trade mark is an important first step. Protecting it is an ongoing responsibility.

Trade mark watching services is the process of monitoring new trade mark applications to identify any that are confusingly similar to your own. Without it, a competitor could file a mark that encroaches on your brand, and if you do not oppose it in time, that window closes.

In South Africa, once a trade mark is accepted and published in the Patent Journal, any interested parties have 3 months from date of publication to oppose registration. Missing that window can have long-term consequences for your brand.

Did you know? A Will that is not signed and witnessed correctly has no legal validity, and an invalid Will is treated as though it never existed.

In South Africa, your Will must be signed in the presence of two witnesses, whom must also sign the document. Those witnesses cannot be beneficiaries, and if they are, their inheritance is disqualified.

It is a simple requirement, but the number of Wills that fail on technicalities and the complications that follow for families is significant.

Can you trade mark a colour? Yes - but it is harder than it sounds.

In South Africa, a colour can be registered as a trade mark only if the public has come to associate it exclusively with your brand over time. Cadbury's purple and Tiffany's robin-egg blue are classic examples, both protected in their respective jurisdictions because those colours belong, in the minds of consumers, to one brand and no one else.

You cannot simply register a colour you like. You have to prove it has become synonymous with your business.

Colours, sounds, and shapes fall under what is known as non-traditional trade marks, a growing and often contested area of IP law. If you think your brand has something worth protecting beyond its name or logo, speak to our IP team.
