Locus Standi

Pronounced: loh-kus STAN-dee

Latin for 'place of standing' but in plain language, it means: Do you have the right to bring this case to court?
Before a court decides whether you win or lose, it first has to decide whether you have the right to be heard at all. That's locus standi.
If you don't have locus standi, your case can be dismissed, not on its merits, but simply because the court finds you aren't the right person to bring it.
In South Africa, our Constitution (section 38) takes a broad approach: a person acting in the public interest, or on behalf of a group, may also have locus standi, even if they are not the one directly harmed.

Understanding this concept is the first step to understanding your access to justice.

You are never too young to have a will.

If you have people who depend on you, children, a partner, ageing parents, you already have a reason to have a will.

In South Africa, anyone 16 years or older can make a valid will. Yet the majority of South Africans die intestate (without one), leaving their families to navigate an often lengthy and stressful estate administration process. Without a will, your estate is distributed according to the Intestate Succession Act, which may not reflect your wishes. Your assets could go to people you wouldn't have chosen, or exclude people you would have.

A will gives you the power to decide:
- Who inherits your assets
- Who looks after your minor children
- How and when your estate is distributed
