ON THE ISSUE OF CHILD MAINTENANCE

If you have a Maintenance Order against you for the Maintenance of your child, it remains your responsibility to pay the custodial parent monthly and keep track and proof of such payments.

However, should you, at the time when Maintenance is due, be living with your child for an extended period (meaning that you will be responsible for the child's day to day needs for a period exceeding a month). You will need to approach the same Court that ordered the Maintenance to inform them that you will not be making payment as per the order for those months and provide reasons.

Failure to inform the court tineously or at all, will unfortunately mean that you defaulted on your Maintenance Order and you are in Contempt of Court, no matter how justified you are.

Defaulting on Maintenance Order is a Criminal Offense, therefore, Criminal Charges will be instituted against you and you will need to appear in Court to pay the custodial parent. Failure to pay can lead to imprisonment up to 3 years and a R1000 fine.

1. You are not allowed to stop paying maintenance because you are prevented from seeing your child. Defaulting on Maintenance is a criminal offense and our Courts take this very seriously.

2. You are not allowed to Prevent the other parent from seeing their child because they do not pay maintenance. Every parent must has a right to see their children whether they can afford to pay maintenance or not.
