📄 That one clause in your title deed could cost you…

Most buyers focus on the price, the house, and the bond approval, but very few actually understand what’s inside the title deed conditions.

⚖️ These conditions can:
• Restrict what you can build
• Limit how the property can be used
• Affect future renovations or extensions
• Even impact resale value

And the problem?

👉 Many people only discover these restrictions after they’ve bought the property.

💡 Pro tip:
Always have your title deed conditions properly reviewed before signing — not after.

It’s one of the most overlooked steps in property transactions… but one of the most important.

🐟 You won’t believe what almost stopped this property transfer…

A dispute over koi fish.

The buyer assumed the fish formed part of the property.
The seller said: “They’re my pets.”

And just like that… a simple transfer nearly turned into a full-blown legal fight.

⚖️ Here’s the reality:
Not everything you see on a property is automatically included in the sale.

If it’s not clearly addressed in the fixtures and fittings clause,
you’re leaving room for dispute.

✔ Curtains or rails?
✔ Light fittings?
✔ Built-in vs freestanding items?
✔ …even fish?

💡 Lesson:
Always make sure the agreement is clear — don’t rely on assumptions.

👇 Now I want to know:

What’s the strangest thing YOU have seen disputed in a property sale?

🐶 LEGAL TIP WITH TIM

Can a body corporate tell you that your dog is too big for your complex?

Many sectional title schemes require owners to obtain permission before keeping pets, and some rules even try to limit the size or type of dog allowed.

However, trustees must still act reasonably when considering a pet application and cannot simply refuse it without proper consideration.

⚖️ Always check the conduct rules of a scheme before buying property if you have pets.

If you have questions about sectional title rules, property transfers, or conveyancing, feel free to reach out.

⚖️ Who chooses the transferring attorney when a property is sold?

Many buyers assume that because they pay the transfer costs, they get to choose the transferring attorney.

In most property transactions in South Africa, that is not the case.

The seller usually appoints the transferring attorney because the seller carries the risk in the transaction until the property is registered in the buyer’s name.

However, in one property transaction there can be up to three different attorneys involved:

• The Transferring Attorney – appointed by the seller
• The Bond Attorney – appointed by the bank
• The Cancellation Attorney – appointed by the seller’s bank

Understanding the role of each attorney helps buyers and sellers navigate the transfer process with more confidence.

🏡 Thinking of selling your property?

One of the biggest causes of delays in property transfers is that sellers only appoint a conveyancer after the sale agreement is signed.

By then, issues like municipal clearance delays, building plan problems, or title deed errors can already slow the process down.

✅ Pro Tip: Get your property transfer-ready before it goes on the market.

This means:

• Ensuring municipal accounts are in order
• Checking building plans for compliance
• Reviewing the title deed for restrictions or errors • Notifying your bank early if you have a bond to avoid 3 months penalty interest.

Taking care of these steps early can save weeks in the transfer process and avoid unnecessary stress for both buyer and seller.

If you are planning to sell your property and want to make sure everything is ready for a smooth transfer, feel free to contact us.
