Unfair Dismissal

Have you been unfairly dismissed from employment by your employer?
Are you being subjected to unfair labour practices?

In order to adequately navigate the work environment, one has to equip themselves thoroughly .

In terms of the Labour Relations Act 66 of 1995, every employee has the right not to be -
(a) unfairly dismissed
(b) subjected to unfair labour practices.

Dismissal means that :
- the employer has terminated employment with or without
notice
- an employee who was employed by the employer in terms
of a fixed term contract reasonably expected the employers
to renew the fix term contract on the same or similar terms,
however the employer renewed it on less favourable terms
or did not renew it at all
- the employer refused to allow an employee to resume work
after taking maternity leave in terms of any law , collective
agreement or contract of employment
- an employer who dismissed a number of employees for the
same or similar reasons decides to re-employ one or more
persons but has refused to re-employ others
- an employee terminated employment with or without notice
because the employer made his/her continued employment
intolerable
- an employee terminated their employment with or without
notice because the new employer, after transfer in terms of
section 197( which deals with transfer contract of contract of
employment) or section 197A (which deals with the transfer
of contract of employment in circumstances of insolvency),
provided the employee with conditions or circumstances at
work that are substantially less favourable to the employee
than those provided by the former employer

Unfair Labour Practices can be construed as any unfair act or omission that arises between an employer and employee which involves :
- Unfair conduct by the employer which relates to the promotion, demotion, probation or training of an employee or relating to the provision of benefits to an employee
- the unfair suspension of an employee or any other unfair disciplinary action short of dismissal in respect of an employee
- failure or refusal by an employer to reinstate or re-employ a former employee in terms of ant agreement
- an occupational determent, other than dismissal , in
contravention of the Protected Disclosures Act 26 of 2000 ,
where an employee made a protected disclosure as defined
in the aforementioned Act

Are you not happy with the outcome or judgement that was given by the court in your case and want to appeal against the decision of the court?

Appeal is an application to a higher court for a reversal of the decision of a lower court.

You can lodge an appeal if your legal representatives are of the view that given regard to the merits of your case, a Magistrate or Judge made a wrong decision and that another Judge could overturn the judgement and give outcome in your favour.

Do you know that as person you can launch an appeal against a criminal or civil matter in a magistrate court or high court?

If the Judge in the High Court dismisses your appeal from the magistrate court, you can petition the Supreme Court of Appeal which is located in Bloemfontein, Free State.

The Supreme Court of Appeal in terms of South African courts is the second highest court and can overrule any decision given by a Judge in any other Court in the Country excluding the Constitutional Court which is the court of final instance.

The following matters are held not to be appealable.

1. The grant of default judgment while is still rescindable.
2. A ruling reserving costs for determination at the trial.
3. Orders to discovery and production of documents
4. The grants of an interdict pendente lite.
