Did you know that in terms of the GCC Fourth Edition (2025), Clause 5.3.1 provides that when the Contractor receives an instruction from the Employer’s Agent, the Contractor must begin the Works, unless the Contract says otherwise or it is legally or physically impossible to do so. However, the Contractor may only start the Works after submitting the required documents listed in the Contract Data and receiving the Employer’s Agent’s approval of those documents.

Did you know that in terms of clause 12.2.7 of the JBCC Principal Building Agreement, Edition 6.2 (May 2018), once a contractor takes possession of a site, they are obligated to start work immediately and proceed with due diligence, regularity, expedition, skill and appropriate resources to bring the works to practical completion and final completion thereafter.

Did you know that under NEC 4 ECC 2017 Edition, Clauses 51.1 and 51.2 state that the Project Manager must certify payment within one week of each assessment date (set by the Project Manager)? Each certified payment must then be made within three weeks of the assessment date or as specified in the Contract Data. If payment is late whether by the Employer or due to the Project Manager, interest is payable on the overdue amount.
