⚖️ Did you know that being married In Community of Property does not always guarantee that you will walk away with 50% of the joint estate when you divorce? 👀

A court may, in certain circumstances, order one spouse to forfeit the patrimonial benefits of the marriage in favour of the other.

Section 9(1) of the Divorce Act 70 of 1979 allows a court to order the forfeiture of patrimonial benefits where, having regard to:

The duration of the marriage;

The circumstances that led to the breakdown of the marriage; and

Any substantial misconduct by either spouse,

the court is satisfied that, without a forfeiture order, one spouse would be unduly benefited in relation to the other.
