Business rescue or litigation tactic?

We recently acted on behalf of the successful applicant in an urgent business rescue application before the North-West High Court. The Court set aside a last-minute section 129 business rescue resolution after finding that it had not been adopted in a genuine pursuit of business rescue, but for an ulterior purpose.

Property transfer stuck because of a municipality?

We recently acted on behalf of the purchaser in a High Court application where the seller, a municipality, failed to provide the required clearance certificates - effectively blocking transfer. The Court compelled the municipality to comply, and our client obtained the relief sought.

A clear reminder: even municipalities are bound to honour their agreements.
