Divorce comes with a vocabulary most people have never needed before. Not knowing these terms can cost you.
1. Antenuptial Contract (ANC) - A pre-marriage agreement that determines how assets and debts are divided. Without one, you are married in community of property and everything is split 50/50 including debt.
2. Decree of Divorce - The court order that officially ends your marriage. Until this is granted, you are still legally married.
3. Parenting Plan - A binding document outlining how you and your co-parent will raise your children post-divorce. It covers custody, schooling, holidays, and more.
4. Spousal Maintenance - Financial support one spouse may be ordered to pay the other after divorce. Not automatic. Must be applied for and motivated.
5. Pension Interest - Your retirement savings can form part of the divorce settlement. Many people are unaware their spouse has a legal claim to a portion of their pension.
