Delayed Visa? You May Have the Right to Take Legal Action.

Many people wait for months or even years for the Department of Home Affairs to decide on a visa, appeal, or permit application. This can affect work, family life, studies, and peace of mind. A Mandamus Application is a legal process used to ask the High Court to compel Home Affairs to make a decision when there has been an unreasonable delay.

The process usually starts with formal letters of demand. These letters give Home Affairs an opportunity to respond and resolve the matter without going to court. If there is still no action, a Mandamus Application may then be filed in the High Court.

A Mandamus Application does not ask the court to automatically approve the visa. Instead, it asks the court to force the Department to do its job and make a lawful decision within a reasonable time.

This process is based on the constitutional right to fair administrative action. It helps hold public institutions accountable and protects people from endless delays. With proper legal guidance, many applicants are able to finally receive movement and decisions on their cases.

Specialists in Accompanying Spouse Visa Applications

For many families, South African immigration law is not just about paperwork — it is about preserving family unity, stability, and dignity.

Under the Immigration Act 13 of 2002, an Accompanying Spouse Visa allows the legally recognised spouse of a foreign national holding a valid South African temporary residence visa to lawfully reside in South Africa with their partner.

This category is commonly used where one spouse holds a work visa, critical skills visa, business visa, or study visa, and wishes for their husband or wife to accompany them during their stay in the Republic.

Unlike a Section 11(6) spousal visa linked to a South African citizen or permanent resident, the accompanying spouse category is tied to the principal visa holder’s temporary residence status.

In most cases, the visa is issued for the same duration as the main applicant’s visa. Importantly, holders of an accompanying spouse visa generally do not receive automatic work rights and must apply separately should they wish to work, study, or conduct business in South Africa.

The Department of Home Affairs places significant emphasis on proving the genuineness of the relationship through marriage certificates, shared responsibilities, financial support, and supporting documentation.

As South Africa continues tightening immigration compliance, properly structured applications and legally compliant submissions are becoming increasingly important for families seeking long-term stability and lawful residence.

South Africa’s immigration landscape is changing — and many foreign nationals are underestimating how significant the next few years may become.

The recently approved Draft White Paper on Citizenship, Immigration and Refugee Protection, approved by Cabinet for public comment, signals a clear policy direction from the South African government:

➡️ stricter immigration enforcement

➡️ stronger verification systems

➡️ increased focus on compliance and regularisation

➡️ tighter management of undocumented migration

➡️ prioritisation of skills, investment and lawful residence pathways

At the same time, public frustration around undocumented immigration, pressure on public services, unemployment, and rising anti-illegal foreigner sentiment continues to shape the national conversation.

Whether one agrees or disagrees with the politics surrounding immigration in South Africa, one reality remains undeniable:

South Africa is moving towards a far more compliance-driven immigration system.

And for foreign nationals currently living, working, studying, or building families in South Africa — this matters.

The days of:

“I will sort out my papers later”

relying on misinformation from social media

overstaying visas

working without proper authorisation

assuming Home Affairs delays will simply disappear …are becoming increasingly risky.

What we are likely to see over the coming years is:

✔️ stronger immigration inspections

✔️ increased employer accountability

✔️ tighter visa adjudication standards

✔️ digital integration of immigration systems

✔️ more scrutiny of fraudulent applications

✔️ increased litigation around delayed decisions

✔️ greater demand for legally compliant immigration pathways

This is why immigration compliance is no longer just a legal issue.

It is now a strategic life issue.

For professionals, families, students, spouses, investors and long-term residents in South Africa, the question is no longer:

“Can I stay in South Africa?”

The more important question is:

“Am I properly regularised under South African immigration law?”
