Not every accident is someone's fault. And not every injury gives rise to a legal claim.
Consider a visitor who suffers a serious injury after falling on a poorly maintained staircase at a commercial property.
The legal question isn't simply whether the visitor was injured. It's whether someone had a legal responsibility to take reasonable precautions, failed to meet that responsibility, and thereby caused the injury.
In South African delictual law, establishing liability requires consideration of several elements, including wrongfulness, negligence, causation and legally recognised harm.
It's the circumstances surrounding an accident, not merely the accident itself, that determine whether a legal claim may exist.
At André de Villiers & Associates, we believe informed legal decisions begin with a proper understanding of the facts and applicable law.
