Het jy ’n Huiswerker of Au Pair? Dan het jy werkgewerverpligtinge.

Negotia Labour Practitioners se Carina Linde het onlangs op die Jaco2 Podcast gesels oor ’n onderwerp wat baie huishoudings onderskat - UIF en COIDA verpligtinge wanneer jy ’n huiswerker, tuinwerker of au pair in diens het.

Een van die grootste slaggate wat sy uitgelig het, is dat daar dikwels geen skriftelike dienskontrak tussen werkgewer en werknemer bestaan nie.

Sonder hierdie dokumentasie raak dit moeilik om diensvoorwaardes, vergoeding, verlof en verantwoordelikhede duidelik te bewys.

Carina het verder beklemtoon dat werknemers betaalstrokies moet ontvang waarop UIF-bydraes aangedui word.
UIF registrasie alleen is dus nie genoeg nie - daar moet administratiewe bewys van nakoming wees.

COIDA is nog ’n area wat baie huishoudings ignoreer.
Indien ’n werknemer beseer word terwyl hy of sy by jou woning werk, kan die afwesigheid van korrekte registrasie en nakoming groot probleme veroorsaak.

’n Belangrike punt uit die gesprek was ook dat die Departement van Arbeid nie bloot daar is om werkgewers uit te vang nie, maar juis om werkgewers te help om voldoenend te wees.

Baie mense besef nie dat arbeidsinspeksies by privaat wonings kan plaasvind wanneer daar huishoudelike of tuinwerkers in diens is nie.

Wanneer jy iemand by jou huis in diens neem, tree jy wetlik as werkgewer op - en UIF en COIDA vorm deel van daardie verantwoordelikheid.

What Do You Do If an Employee Refuses to Attend a Disciplinary Hearing?

This throws a lot of employers off.

You’ve followed the process.
You’ve issued the notice.
You’ve set the hearing.

And then:
“I’m not attending.”

An employee does not get to stop a disciplinary process by refusing to attend.

Where employers go wrong:
They panic or stall the process.

What you should do:
- Ensure proper notice
- Give a reasonable opportunity
- Record the refusal
- Proceed if necessary

The CCMA will look at whether your process was fair.

Bottom line:

An employee cannot hold your process hostage.
