The biggest fear is losing everything. But on a voluntary surrender you can, in certain circumstances, buy your own assets back from the estate - in equal instalments over one to 24 months, with no interest and no hidden costs. Your things stay where they are.

The debt that remains is written off by the court on rehabilitation. Rehabilitation is a separate application, and it is the step most people are never told about.

It is not for everyone. We say so plainly when the answer is no, before any fees.

Why would the creditors agree? Because they are better off for it. An auction costs money and brings in little. A buy-back makes those costs disappear and the price arrives in the estate whole - they receive more, and your things stay where they are.

There is something about wills that catches good parents completely off guard.

If you die while your children are still minors, the person raising them cannot simply receive their inheritance. Unless your will says otherwise, that money must be paid over to the Guardian's Fund, administered by the Master of the High Court, where it sits until each child turns 18.

The Fund is honestly run and it costs nothing. But whoever is raising your child must apply to the Master, on the prescribed form, with quotations and accounts, every single time there are school fees to pay, uniforms to buy, or a doctor to see. There is a ceiling on how much of the capital the Master may release for maintenance. And money that nobody claims is forfeited to the state after thirty years.

Most people have never heard of this. It is not the sort of thing anyone tells you.

There is a straightforward answer, and it is written into the will itself: a testamentary trust. You choose the trustees, and your children's inheritance goes to them instead of to the Fund - available for school and medical costs without a government form in sight, and handed over at the age you decide, whether that is 18, 21 or 25.

A will drafted with you, signed properly under our supervision and kept in our safe custody, is R800. With a testamentary trust for minor children, R1,600.
