Legal myth: If you ignore court papers, the problem just goes away.

Reality: It usually gets worse.

Ignoring summons, applications or notices can result in default judgments or adverse cost orders against you and without further notice to you.

Therefore if you receive legal documents, deal with them promptly and don’t delay.

Preparation is always better than reaction.

What is the purpose of an arrest?

Many people think an arrest means “you are guilty” or that it’s meant to punish.

It isn’t.

The primary purpose of an arrest is to secure the attendance of an accused person at court so the matter can be dealt with through the justice system: charged, tried, and ultimately convicted or acquitted.

Because arrest is a serious limitation of freedom, it should not be used as a form of punishment or intimidation. In appropriate circumstances, a summons or written notice (warning) to appear in court may be issued instead of arrest.

Key rights to remember (Section 35)

- If you are arrested, you have rights including but not limited to:

- To remain silent and be informed of that right (and the consequences of speaking)

- To be brought before court as soon as reasonably possible, but no later than 48 hours (with the court-day qualification)

- To consult a legal practitioner

- Not to be compelled to make a confession/admission

Understanding this distinction matters: arrest is a procedural step within the criminal justice system. It is not punishment or a conviction under South African law.

Urgent Court Applications: When “Now” Really Means Now

Many people think a matter will be heard urgently just because it feels urgent.

That’s not how the courts see it.

An urgent application is a special legal process you use when waiting for the normal court timetable would cause serious prejudice or irreparable harm, harm that simply cannot wait.

📌 What makes a matter truly urgent?

To qualify for urgency, you must convince the court that:

• Waiting for normal procedures would mean you cannot get substantial redress in the ordinary course;
• The harm or risk is serious, immediate and not something that can be fixed later;
• You cannot reasonably solve the problem without going to court urgently;
• The urgency isn’t self-created by delay or inaction.

Examples that might justify urgency include matters where rights could be lost forever: for example preventing unlawful eviction, stopping imminent harm, or protecting children in time-sensitive situations.

🧠 Important things to know

⚖️ Not every “important” case is urgent. Commercial disputes or general disagreements usually aren’t enough on their own.

📋 The court decides urgency on the facts. Just saying a case is urgent doesn’t make it so, you must show why normal timelines won’t protect your rights.

⏱️ Self-created urgency is a risk. If you delay too long before launching your urgent application, the court may refuse to hear it as urgent.

🧑‍⚖️ Court’s mindset

Urgent applications are extraordinary remedies. Courts will only grant them when it’s genuinely necessary, not simply because time is inconvenient or the matter is important to you.

Before assuming your matter is urgent, obtain proper legal advice. Incorrectly enrolling a matter as urgent can delay your case and increase costs.

What actually happens after you “open a case”?

Many people assume that once papers are issued, court happens immediately.

It usually doesn’t, unless the matter is enrolled on an urgent basis and urgency is granted by the court.

The action process (summons procedure) generally unfolds as follows:
1. Documents are drafted and issued.
2. The other party is formally served.
3. They are afforded time to file a notice of intention to defend and plead.
4. Pleadings close.
5. The matter is enrolled and/or case-managed.
6. Only then does it proceed to hearing or trial, if it does not settle before then.

Litigation is procedural.
It is structured.
And timelines are governed by the Rules of Court.

Understanding the process helps manage expectations and reduce unnecessary anxiety.

The start of this year has been exceptionally busy behind the scenes, and our focus has been exactly where it should be: serving our clients, meeting deadlines, appearing in court, attending to transfers, and building solid legal foundations.

Growth sometimes looks quiet from the outside.

But it has been happening.
