Co-parenting during and after divorce

Why it matters

Benefits for children

Children whose parents cooperate adjust better emotionally and academically after divorce

Reduces children's sense of being caught in the middle of parental conflict

Provides consistency in routines, discipline and expectations across two homes

Preserves meaningful relationships with both parents and extended family

Co-parenting principles

1. Never speak negatively about the other parent in the child's presence
2. Communicate about the child's needs — not the marriage breakdown
3. Use a parenting plan to formalise agreed arrangements (encouraged by the Act)
4. Be flexible and child-focused, especially during the transition period

Formalities of a valid will in South Africa

In South Africa, the Wills Act 7 of 1953 governs the requirements for a valid will. All of the following must be met:
The testator (person making the will) must:

Be 16 years or older
Be mentally competent at the time of signing — they must understand what they own and what they are doing

The will must be in writing — handwritten or typed, on paper
Signature:

The testator must sign at the end of every page, and at the end of the will (if more than one page)
If unable to sign, the testator may make a mark, or direct another person to sign on their behalf in their presence

Witnesses:

Two competent witnesses must be present when the testator signs
Both witnesses must sign every page in the presence of the testator and of each other
Witnesses must be 14 years or older and mentally competent
A beneficiary (someone inheriting under the will) or their spouse should not be a witness — doing so does not invalidate the will, but that beneficiary loses their inheritance under it
