If you’ve ever had to retrench staff, you’ll know it’s already costly and complex, but proposed changes to the Labour Law Amendment Bill could double that cost.

The Bill currently before Parliament proposes increasing statutory severance pay from 1 week to 2 weeks per completed year of service. That means a 10-year employee could go from costing 10 weeks’ pay to 20 weeks.

Other key proposed changes include:
⚠️ Gig and freelance workers potentially gaining full employee protections, including dismissal rights and UIF claims.
⚠️ Updated probation rules, allowing more flexibility in the first 3 months if properly documented.
⚠️ All harassment disputes (not just sexual harassment) becoming referable to the CCMA.

The Bill is not yet law, but it is progressing quickly. Now is the time to review contracts, update HR policies, and understand your exposure.

RATE HIKE ALERT | The SARB's Monetary Policy Committee has increased the repo rate by 25 basis points to 7.00%, pushing the prime lending rate to 10.50%. Effective 29 May 2026.

South Africa’s Wills Act 7 of 1953 prescribes strict formalities for the valid ex*****on of a will. Even minor deviations can render a will invalid or lead to disputes, delays, and costly litigation. It is strongly recommended that wills be prepared and executed under the guidance of a qualified attorney.

Under Section 2(1)(a) of the Wills Act, a will is valid only if the following requirements are met:

• The will is signed at the end by the testator (or by another person in the testator’s presence and by the testator’s direction).
• Such signature is made or acknowledged by the testator in the presence of two or more competent witnesses who are present at the same time.
• The witnesses then attest and sign the will in the presence of the testator and of each other (and of the person who signed on the testator’s behalf, if applicable).
• If the will consists of more than one page, the testator (or the person signing on their behalf) must also sign each page other than the last page anywhere on that page.

Important best practices to reduce risk:

• Use full wet-ink signatures (physical pen-and-paper signatures). Digital or electronic signatures are not recognised for wills under South African law.
• Although the Act does not strictly require witnesses to sign every page, it is prudent for both the testator and the two witnesses to sign or initial every page to demonstrate that no pages have been substituted or altered.
• Witnesses must be competent (generally persons aged 14 years or older who are capable of giving evidence in court) and should not be beneficiaries under the will or the spouses of beneficiaries, as this may disqualify them from inheriting.
• The testator should be at least 16 years of age and possess the necessary mental capacity at the time of ex*****on.

Common pitfalls that frequently cause problems:

• Signing the document in the middle or elsewhere instead of at the very end.
• Witnesses signing at different times or not in each other’s presence.
• A witness who is also named as a beneficiary (this can disqualify that beneficiary from inheriting under the will).
• Failure to ensure the testator signs every page of a multi-page will.
• Relying on a digital or electronic signature.

One small error in ex*****on can result in the will being rejected by the Master of the High Court, triggering intestate succession rules instead of your intended wishes.

South African courts have broken new ground and it affects long-term partners who aren’t married.

In March 2026, the Western Cape High Court granted its first interim maintenance order to an unmarried life partner (P.A.L v R.J.T [2026] ZAWCHC 99).

In simple terms: if you’ve built a shared life and finances with a partner, you may now have grounds to claim maintenance after a breakup, even without a marriage certificate.

This marks a shift, but it doesn’t mean unmarried partners have the same rights as married couples, not yet.

For individuals: understand your position, whether you may claim or be liable.
For business owners: personal relationships can impact your estate and business.

On 1 April 2026, three new tax laws came into effect in South Africa:
📌 The Rates and Monetary Amounts and Amendment of Revenue Laws Act
📌 The Tax Administration Laws Amendment Act
📌 The Taxation Laws Amendment Act

A month later, many small business owners still haven’t reviewed their contracts.

If you're thinking about selling your home this year, there’s a tax update that could save you money.

For the 2026/2027 tax year, the Capital Gains Tax (CGT) exclusion on a primary residence has increased from R2 million to R3 million.

What this means:
🏡 The first R3 million of any capital gain is tax-free
🏡 If your home’s value increased by less than R3 million, you may owe zero CGT
🏡 The exclusion also applies to deceased estates
This is a significant benefit, especially in high-growth areas.

To make the most of it, ensure your primary residence is correctly recorded, your estate plan is up to date, and the sale is structured properly.
