Before You Sign | Buying a Property You Haven't Seen

Buying a property without viewing it in person is becoming increasingly common. Virtual tours, photographs and online listings have changed the way many people buy property.

Before you sign an Offer to Purchase, however, take a moment to consider the voetstoots clause. This clause generally records that the buyer accepts the property in its existing condition, having had the opportunity to inspect it before signing.

Where a buyer has not viewed the property, additional clauses are needed to protect both buyer and the seller. Without those provisions, the application of the voetstoots clause can become legally uncertain and may give rise to disputes later.

! Conveyancing in the Bay News !
One of the most common causes of transfer delays relates to obtaining municipal rates clearance certificates for accounts that are billed on estimated consumption. Estimated billing typically occurs where meters are not accessible for municipal readings.

When a property is sold, those estimates must be reconciled against actual usage before clearance figures can be issued, and that reconciliation process can substantially delay registration.

We advise property owners to ensure their meters are accessible, or to submit readings via the municipal app (NMBM Mobile Application on the Google Play Store or Apple App Store) or the NMBM E-Services Portal within five days of receiving their monthly SMS reminder.

Accurate and timely readings reduce the risk of unexpected adjustments during a transfer.

It’s Not a Stupid Question: “How much will I actually receive from the sale?”

It is entirely reasonable to want to know what the net proceeds of your sale will be.
Once the transfer documentation has been signed and the relevant figures are available, the expected proceeds can be calculated. This includes bond settlement amounts, rates and levy clearances, commission and transfer costs.

Clarity removes uncertainty. Asking the question is part of the process.

CORRECTING THE RECORD: “A transfer takes three months.”

There is no fixed timeline for a property transfer.

The idea of “three months” is an old rule of thumb, based on a month for finance, a month for attorneys and a month for the Deeds Office. In practice, bond approval can often be secured within days, and once lodged, registration at the King William’s Town Deeds Office typically takes five to seven working days.

The greater variable lies in the preparation phase. Lost title deeds, municipal clearance delays where estimated charges must be reconciled against actual consumption before clearance figures can be issued, or interdicts that require resolution can extend the process.

Each transfer progresses according to the facts involved.
