There is no specific age at which a childโ€™s voice becomes the only factor taken into consideration in determining a childโ€™s best interests. In terms of section 6 of the Childrenโ€™s Act 38 of 2005 a childโ€™s voice must be heard as one of the factors in determining a childโ€™s best interest but not the only factor. The childโ€™s voice is also considered within the context of each childโ€™s age, stage of development and level of maturity and therefore case specific. Children may have a view on where they wish to live, but the childโ€™s reasons and motives are also investigated within the broader context of section 7 of the Childrenโ€™s Act. Therefore, a childโ€™s wish and voice are not seen in isolation to the balance of factors taken into account in determining a childโ€™s best interests.

The Family Advocate considers various factors, including the children's age, maturity and stage of development. The childrenโ€™s relationship with each parent, their physical and emotional well-being, their home environment, interviews with collaterals such as the school, teachers and other family members. Allegations of abuse or neglect are also considered. Section 7 of the Childrenโ€™s Act 38 of 2005 sets out the guidelines followed by the Family Advocate in determining a childโ€™s best interests.
