HOW TO DRAFT A NOTICE OF MOTION BY HEART - Easy peasy!

Memorize these acronyms and thank me forever.

6 things are very important as per the rules of the court;

1. K.T.N.A: KINDLY TAKE NOTICE than an application will be made to this above honourable court for ;

2. TERMS OF ORDER: an order in the following terms - this is where you write what you want the court to do.

if it's an urgent application, the terms of order must begin with;

(a) That this application be entertained as a matter of urgency

(b) Continue with other terms in sub paragraphs as per the set of facts, don't forget that you must RULE NISSI - this is the time frame that the respondent has to respond and show cause as to why the application should not be granted or made an order.

3. ANNEXURE: Supporting affidavit and other document in support of the application must be attached and marked as Annexure A, B, C, etc depending on how many supporting documents you intend to attach. You will see this from the set of facts.

4. COA: COST OF THIS APPLICATION - who must bear the cost of the application, this is important as per the rules, if you don't state this, you will lose mark, in practice, you cannot claim such cost from the other party if you didn't state so in your application.

5. FAR: FURTHER/AND OR ALTERNATIVE RELIEFS - always plead for this in your application, you are asking the court to grant any other relief besides the one you are seeking as they deem fit.

6. KEMA: KINDLY ENROLL THE MATTER ACCORDINGLY - that the matter be enrolled for hearing so that the court can make a ruling as they deem fit.

- Signature and address of the attorney, telephone number, fax etc.

- Notification to the officer of the court of Juridiction and all the parties concerned in the matter.

In terms of the new Legal Practice Act, legal practitioners will be split into two categories, attorneys and advocates, gone are the days when jurists with LLB degrees will be admitted as side bar advocates. In future, all advocates must be admitted to the bar by the High Court of South Africa, to be recognised officially as members of the South African Society of Advocates.

JOHANNESBURG - The Constitutional Court on Friday ruled in favour of a Free State
municipality saying residents cannot pick and choose the services they pay for.
A Kroonstad resident refused to pay her full council bill in 2008 saying she had not received the services she was paying for.
The case went to the Constitutional Court after she appealed the Supreme Court's decision which ruled in favour of the municipality.
Justice Raymond Zondo dismissed Olga
Rademan’s appeal saying the Moqhaka
Municipality had the right to cut her electricity because she did not pay her bill in full. Rademan paid her electricity and waste removal but refused to pay rates and taxes in protest against poor service delivery. While Zondo agree that no money is due if a service is not rendered he says residents have no right to refuse to pay a bill in full and therefore the municipality was entitled to cut her power supply in terms of the bylaws to ensure people do not just pay for the services they choose to. The ruling will be a blow to the more than 200 ratepayers associations around the country who have either declared a dispute with their municipalities or chosen to take over municipal services. In August 2009, the municipality disconnected Rademan's electricity without obtaining a court order. She had allegedly incurred arrears of R2986.96. The Kroonstad Magistrate's Court then granted Rademan an urgent interdict, forcing the municipality to reconnect her electricity.
The municipality then successfully appealed the matter at the Free State High Court.
