The Children's Act provides that parents can enter into a contractual arrangement which is identified as a parenting plan. This document outlines parental rights and responsibilities after separation or divorce. The parenting plan must be in line with the best interests of the child principle, it should be in a prescribed form and deal with the following:

(1) where & with whom the child is to live (primary residence)
(2) the maintenance of the child;
(3) contact between the child & any other person
(4) schooling & religious upbringing of the child

Having a parenting plan supports parent to foster a stable and respectful co-parenting relationship where both parties can articulate, negotiate & cooperate on the matters that affect their family. This also minimizes potential conflict between the parents. Most importantly, parenting plans protect the children's rights by prioritizing their best interest & ensure that their needs are properly ventilated.

Our laws discourage "fighting things put in court" before talking through and trying to find amicable solutions. A parenting plan serves that very purpose.

Once it is finalized, it must be signed by both parties. Keep in mind that a parenting plan would need to be approved by court before it is legally binding on parents. The parenting plan may be incorporated in a divorce settlement or registered at the Family Advocate's office.

Before getting married, couples usually attend pre-marital counselling to ensure they are equipped for the journey they are about to embark on. Equally important is the aspect of the parties marital regime. Please consult with your attorney BEFORE you send your uncles to your bride/makoti's family. People are still not aware that once the lobola negotiations are completed, this is a valid marriage that can only be dissolved through a court order. Should the relationship end, you are still legally married unless a divorce decree is issued.

Both the Constitution and PIE Act require that the court MUST consider the personal circumstances of the occupants in determining whether, and if so, on what conditions, an eviction would be "just and equitable".

Therefore no one can forcefully remove you and/or demolish your structure as an illegal occupant without a court order. Homeowners therefore need to ensure that they follow all the due processes in ensuring that an eviction is lawful.
