Buying a property is one of the biggest financial decisions you’ll make, and two words in your Offer to Purchase can carry significant legal implications.

A voetstoots clause generally means purchasing a property in its existing condition, including certain defects. But does that mean a seller can simply hide a problem and walk away? Not necessarily.

South African property law distinguishes between defects a buyer can reasonably identify and hidden defects deliberately concealed by a seller. The application of a voetstoots clause also depends on the circumstances of the sale and applicable legislation.
