Isiah 54:17
No weapon that is formed against thee shall prosper; and every tongue that shall rise against thee in judgment thou shalt condemn. This is the heritage of the servants of the LORD, and their righteousness is of me, saith the LORD.
The first part of verse 17 is a promise. The second part is a condition. For every promise in God’s kingdom there is a condition.Claiming a promise when we have not satisfied the condition does not bring the results.God says if you are my servant they will form weapons but such weapons will not destroy you.When these weapons fail they will try and use their tongue or their judgment (you can say their distorted law) to find you guilty of things that you did not do just like it happened with Christ. The inheritance is that these tricks will not work.God will use our righteousness to shine the light. lf we do not possess such righteousness, we are defeating God’s purpose because in response God want to say to our accusers”You see, my servants are righteous. Good Morning.

Section 158 1B of the Labour Relations Act 66 of 1995 provides that when parties are engaged in arbitration proceedings, be it at the CCMA or Bargaining Council, they may not refer the matter to the Labour Court for review before the dispute is finally determined unless it is in the interests of justice for the Court to deal with it at that stage. See ( Famous Brands Management (Pty) Ltd v SAMWU obo Magolego & 632 others at paragraph 8. By way of example, say you raise a point of law in an arbitration and the Commissioner rules against you.In terms of the above section you cannot review that ruling until the arbitration has been concluded unless the interests of justice permits.One of the reasons is that if you refer the ruling for review before the arbitration is concluded, it may happen that when the arbitration award is finally issued in respect of the whole proceedings, either party is aggrieved by the award and decides to approach the Labour Court for a review. At this stage the Labour Court will be dealing with a review in respect of the same arbitration proceedings for the second time. It is for the this reason that a party should wait until the matter is finally determined so that there is only one review in respect of the arbitration proceedings and not a piece-meal consideration of the matter by the Labour Court.It saves time and costs.

“Nemo plus iuris rule” dictates that you cannot transfer more rights than you have.To dispose of something in a will you must have the right of ownership over it.If it is in a Trust, you do not own it and can’t dispose of it through a will.To answer your question, you still require a will in respect of the assets you still own even when there is a Trust.Yes creditors cannot attach assets in a Trust because they do not belong to you.I think a will is overrated.The law that applies when there is no Will (intestate succession)is in my view very equitable and just.We will one day touch on it.

A Trust is not an instrument to hide assets from spouses and tax authorities and neither is it an instrument for racketeering.Like its name, it is based on trust.Once you place an asset in a trust you lose ownership thereof completely.
Because l was once a teacher l am going to use my remaining teaching skills to explain what it is.This is what it is.”You want to leave something for your children but worried that they are still young and if you happen to pass on they can’t handle it well.You then give it to someone called a “Trustee”because you trust that the “Trustee”can take good care of it on behalf of your children or beneficiaries.It is important that you understand that once you have appointed a “Trustee”, you cannot control him or her.If you control the trustee and it is clear that the trustee does not have independence, then the Trust is an alterego, an extension of yourself and a sham. Courts may find that there is no Trust under such circumstances which will defeat the purpose.There are many types of Trusts.The one l have illustrated is the basic and a simple one.

The BEE Commission investigates complaints including complaints pertaining to fronting among others.In terms of the regulations promulgated pursuant to the act,the commission has a period of a year to investigate a complaint but may in terms of regulation 15(15) seek an extension in order to continue to finalize the complaint. It is this extension that l want to comment on.This extension is not there for the taking.Imagine having waited for a report for a year and then the commission comes back and seek an extension without furnishing you with the reasons why it could not finalize its work.I would quickly suspect that they did nothing.It is for this reason and for accountability considerations that regulation 15(15) requires the commission to furnish circumstances which led to the need for an extension.
I will in my next post comment on how companies front our own people making millions while they live in abject poverty.
