🌍 HUMAN RIGHTS

On 10 December 1948, the United Nations General Assembly adopted the Universal Declaration of Human Rights (UDHR) — a landmark document that laid the foundation for freedom, justice, and peace worldwide.

Drafted under the leadership of Eleanor Roosevelt, the UDHR sets out 30 fundamental rights and freedoms that belong to every person, everywhere. Its core message remains as powerful today as it was over 75 years ago: every human being is born free and equal in dignity and rights.

Although not legally binding itself, the UDHR has influenced more than 60 international human rights instruments and countless national constitutions, including South Africa's Constitution.

"The recognition of the inherent dignity and equal rights of all members of the human family is the foundation of freedom, justice and peace in the world."

The Magna Carta ("Great Charter") is one of the most influential legal documents in history. Sealed by King John on 15 June 1215 at Runnymede, it established the principle that even a king is subject to the law.

Why Was the Magna Carta Created?

King John's unpopular rule, heavy taxation, and military failures led English barons to rebel against him. To avoid civil war, the king agreed to a charter that limited royal power and protected certain rights and freedoms.

Key Principles of the Magna Carta

The rule of law: No one, not even the monarch, is above the law.
Due process: People cannot be imprisoned or punished without lawful judgment.

Protection from arbitrary government action: The king's power was restricted.

Access to justice: Legal disputes should be resolved fairly and according to established procedures.

Protection of certain rights and property: Individuals were given greater security against abuses of power.

Impact on International Law

Although originally intended to address disputes in medieval England, the Magna Carta's principles influenced legal systems across the world. It inspired:

Constitutional government
Human rights protections
Democratic governance
Modern concepts of justice and equality before the law

Its influence can be seen in documents such as the United States Constitution, the United States Bill of Rights, and international human rights instruments including the Universal Declaration of Human Rights.

Significance Today

More than 800 years later, the Magna Carta remains a powerful symbol of liberty, justice, and the limitation of governmental power. Its enduring legacy is the idea that governments must operate within the law and respect the rights of individuals.

"To no one will we sell, to no one deny or delay, right or justice." — Magna Carta, 1215.

⚖️ Landmark Case: S v Makwanyane (1995)

In one of the most significant decisions in South African legal history, the Constitutional Court abolished the death penalty, affirming that the rights to life, dignity, and freedom from cruel, inhuman, and degrading punishment are fundamental to our democracy.

The judgment in S v Makwanyane marked a decisive break from the injustices of the past and established human dignity as a cornerstone of South Africa's constitutional order.

A landmark ruling that continues to shape the protection of human rights in South Africa today.

🇿🇦 SOUTH AFRICAN LAW
South Africa's Constitution: One of the Most Progressive in the World

Adopted on 8 May 1996, the Constitution of the Republic of South Africa is widely regarded as one of the most progressive constitutions in the world.

Section 9 of the Bill of Rights explicitly prohibits unfair discrimination on grounds including:

✔️ Race
✔️ Gender
✔️ S*x
✔️ Pregnancy
✔️ Marital Status
✔️ Ethnic or Social Origin
✔️ Colour
✔️ S*xual Orientation
✔️ Age
✔️ Disability
✔️ Religion
✔️ Conscience
✔️ Belief
✔️ Culture
✔️ Language
✔️ Birth

The inclusion of sexual orientation was groundbreaking, as no other national constitution at the time provided such explicit constitutional protection.

South Africa also became the first country in Africa to legalise same-sex marriage through the Civil Union Act 17 of 2006.

"The Constitution belongs to all who live in South Africa and affirms the values of human dignity, equality, and freedom."
