We are currently investigating reports of an individual falsely posing as an Attorney usually at the Magistrate Court in Mbombela targeting vulnerable clients without representation saying he works for the firm purportedly named 'Themba or Thabo something.' We urge the public to exercise caution.

To verify the legitimacy of any attorney or law firm, we strongly advise consulting the official website of the Legal Practice Council and reviewing the list of registered attorneys and associated firms. It is crucial to ensure that the person claiming affiliation with a particular firm is indeed listed on the LPC website.

Please be aware that there are numerous scammers and opportunists targeting the public. Protect yourself by conducting due diligence before engaging with any legal professional.

In South African customary law, if you paid lobola AND celebrated the marriage according to custom, it is legally recognized as a full marriage.
This means you cannot dissolve the marriage through a family meeting, you MUST obtain a formal divorce order from the court.
The marriage has full legal standing, affecting property, inheritance, and future marriages. Failure to get a court ordered divorce can lead to serious legal complications.

How We Helped Our Client

Recently, we successfully handled the dissolution of a customary marriage. Our client had the original lobola agreement, where the full bride price was not paid, but all customary rituals had been observed. Most family members would say "uyakweleta ngoba akakhiphi yonke so kute Mshado".......meaning the full amount was not paid so there is no marrriage. A valid marriage still exists.

Despite a family meeting taking place, the customary marriage was legally recognized, and we secured a decree of divorce for our client. This ensured their legal freedom and protected their rights.

Don't assume unpaid lobola is a valid reason to dispute a customary marriage, ensure your divorce is legally recognized!

Registering a customary marriage is like setting the record straight nje ! It’s more than a formality; it’s a safeguard.When a customary marriage is registered, it makes things like maintenance, inheritance, and property rights so much clearer.

Think about it like this: As old as time.... even Judas claimed he didn’t know JESUS! 😅 So, who are you – Sbari/Makot!... Don’t let your marriage be "ambiguous." If lobola was paid and all traditional customs were completed, go register that marriage before it’s too late.

And heads up, my Dhiye – if your partner skips town and marries someone else, you could still be legally married! Formal divorce in court is a must. Protect your rights. 🖊️💍
