No will. What happens next?

When someone dies without a will in South Africa, this is called intestate succession, and it works like this:

If there's a spouse AND children: they share equally (spouse gets a child's share or the minimum spousal amount — whichever is more)

If there are only children: they share equally

If there are no children: it goes to parents, then siblings, then further family

The state does NOT take your estate if you have living relatives.

But intestate estates can be complicated — especially when there are step-children, second marriages, or no clear next of kin.

Someone passed away. Now what?
Nobody tells you what to do when someone dies.

Here's what South African law requires:

Step 1: Report the estate to the Master of the High Court within 14 days of the death.

Step 2: An executor is appointed — this is the person who will officially manage the estate.

Step 3: A notice is placed in the Government Gazette so creditors (people the deceased owed money to) can come forward. They have 30 days.

Step 4: All the assets and debts are listed in a document called the Liquidation and Distribution account.

Step 5: Once the Master approves it, the estate is distributed to the heirs.
