Which countryโ€™s law should determine the proprietary consequences of their marriage?

This was the complex question behind a recent Western Cape High Court judgment. Instead of allowing the husbandโ€™s domicile alone to decide the issue, the Court proposed looking for a genuine and meaningful connection between the spouses, their marriage and the applicable legal system.

The judgment reflects the realities of modern international relationships, but the new approach is not yet in force. Constitutional Court confirmation is still required.

For property practitioners, the lesson is simple: never assume that South African matrimonial property law automatically applies because the property is situated here.

A family member cannot sell a home simply because they live there, contribute towards its expenses or expect to inherit it.

Possessing the title deed is also not the same as having the authority to sell the property.

If the registered owner is alive, the owner will usually need to sign the sale agreement, subject to the ownerโ€™s marital regime, legal capacity, co-ownership arrangements and any restrictions affecting the property.

If the registered owner has died, the property must be dealt with through the deceased estate. A family member cannot assume the executorโ€™s authority without being formally appointed.

The family home does not automatically pass to the person living in it or to the person the family believes should inherit it.

The property generally becomes an asset in the deceased estate. The estate must be reported to the Master of the High Court, and an executor or Masterโ€™s representative must be formally appointed to administer it.

Even if a will leaves the home to a particular person, the property does not transfer automatically. The estate administration and property transfer processes must still be completed.

WOMEN WHO CHANGED THE PROPERTY LANDSCAPE | PART 3
Women in polygynous customary marriages were once particularly vulnerable under property systems that placed ownership and control of marital property largely in the hands of the husband.

The Ramuhovhi case challenged the unequal treatment of wives in polygynous customary marriages concluded before the Recognition of Customary Marriages Act came into effect.

WHAT DID THE COURT DECIDE?
In 2017, the Constitutional Court declared the discriminatory law invalid.

The judgment did not award a specific property to Matodzi Ramuhovhi. It recognised that wives in these marriages should have joint and equal rights to manage and control marital property, strengthening their ability to protect their interests in family property and deceased estates.

The Ramuhovhi case did more than challenge an unfair law. It helped strengthen the property rights of women in polygynous customary marriages across South Africa.

After more than 40 years of marriage, Elizabeth Gumede faced divorce under an old customary property system that treated her husband as the owner of the family property.

Mrs Gumede had raised their children, cared for the household and contributed to the family throughout the marriage. Yet the law did not recognise her as having an equal interest in the property built up during their life together.

In 2008, the Constitutional Court declared the discriminatory provisions invalid.

The Court did not award Mrs Gumede either family home outright. Instead, her monogamous customary marriage was recognised as being in community of property. This gave her an equal interest in the joint marital estate, with the final division of the property to be dealt with during the divorce.

Elizabeth Gumede did more than challenge an unfair law. Her courage helped secure equal matrimonial property rights for women in older monogamous customary marriages.

Your family may have lived in the same home for many years. You may contribute towards the bond, rates, maintenance or improvements. But do you know whose name appears on the title deed?

A Deeds Office search can confirm important information, including:
