Can a social media post lead to a defamation claim?

A recent High Court matter involving social media commentator Musa Khawula highlights the potential legal consequences of making defamatory allegations online.

Businessman Senzo Tsabedze approached the court over posts on X in which Khawula allegedly made claims about his personal life. Tsabedze sought the removal of the posts, an apology and an order preventing further publication of the allegations.

The dispute centred on whether the deceased's long-term girlfriend qualified as a recognised dependant under South African pension law.

The case is a reminder that pension death benefits do not automatically form part of a deceased estate. Instead, retirement fund trustees must distribute these benefits in accordance with the Pension Funds Act by identifying legal and factual dependants, rather than simply following a will or the rules of inheritance.

Eviction in South Africa is not as simple as asking someone to leave.

The law is very specific about how and when a landlord can remove a tenant from a property and getting the process wrong can result in costly delays, court appearances, and an eviction that is set aside entirely.

Under the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, known as PIE - no person may be evicted without a court order. This applies even when a lease has expired, when rent has not been paid, or when the occupation was never formally agreed to.

For landlords, this means following the correct legal process from the very first step. For tenants, it means you have rights that cannot simply be overridden by a letter or a changed lock.

A lease agreement is a binding contract. What is written in it and what is left out will determine your rights if a dispute arises with your landlord or tenant.

Some of the most common issues we see:

When things go wrong, whether through a breakup or the death of a partner, the law will not fill in the gaps you never got around to addressing.
