A motor vehicle accident can have consequences that extend far beyond the physical injuries sustained by an accident victim. Where an injury affects a person’s ability to work and earn an income, the financial consequences may continue for many years after the accident.
The purpose of compensation is not to provide the claimant with a windfall. Rather, the objective is to place the claimant, as far as money can, in the position in which they would have been had the accident not occurred.
In South African Road Accident Fund litigation, a claimant may therefore seek compensation for past loss of earnings as well as future loss of earnings or diminished earning capacity, provided that the applicable legal and evidentiary requirements are satisfied.
These expressions are frequently used interchangeably; there is an important distinction between loss of earnings and loss of earning capacity.
Loss of earnings:
Loss of earnings generally concerns actual income that the claimant has lost as a result of the accident, like if the claimant couldn’t work for six months following the accident they lose six months salary.
Loss of earning capacity:
A claimant may return to work and continue receiving an income, the injuries may nevertheless have reduced their ability to compete in the labour market or progress in their chosen career
Loss of earning capacity claims involving children can be more complex because a child may not yet have entered the workforce.
In such circumstances, experts may consider factors such as the child’s educational background, academic potential, family circumstances and other available evidence when assessing the likely career and earnings the child could reasonably have achieved.
Future loss of earnings is generally more complicated because it requires the court to make a prediction about the claimant’s future.

On 26 August 2026, the Legal Practice Council issued a notice that will come as considerable relief to candidate legal practitioners across South Africa.

At the start of 2026, candidates understood the position clearly: 2026 would be the final year in which the four-paper Competency-Based Assessment could be written. Outstanding papers had to be cleared within that window, failing which accumulated credits would be forfeited and candidates would be forced onto a new five-paper CBA. A special November/December 2026 sitting was floated as a last opportunity.

The new notice does away with this timeline. The four-paper syllabus will now run until the August 2027 sitting, for one additional year. The special November/December 2026 sitting has been cancelled and replaced with two further opportunities, in March and August 2027, to complete outstanding papers. The five-paper syllabus, built around the fifteen compulsory modules prescribed under regulation 6(10) of the Legal Practice Act regulations, now only commences in March 2028.

It points to the same underlying issue: the five-paper system was not ready to replace the original schedule

For candidates who were racing against the original 2026 deadline, might consider this good news. An extra year, plus two additional sittings instead of one, meaningfully reduces the pressure to pass outstanding papers under difficult circumstances — often while completing articles.

Candidates who treat this as licence to defer indefinitely will find themselves in exactly the position the original notice tried to avoid. For now, no extension will be granted beyond the August 2027 sitting.

Candidates would be wise to treat August 2027 as a genuinely final deadline, rather than assuming a fourth notice will arrive to move it again. Tread with caution and good luck!
