Can you stop paying maintenance?

One of the biggest misconceptions we hear is:

❌ “If I’m not seeing my child, I don’t have to pay maintenance.”

This is not how it works.

Maintenance and contact are separate matters. A parent’s maintenance obligation does not automatically fall away because they are being denied contact with their child — and withholding maintenance does not automatically give a parent the right to withhold contact.

Even when circumstances change, you should not simply stop paying maintenance.

If you can no longer afford your existing maintenance obligation, there are legal avenues available to apply for a variation of the maintenance order.

Let’s talk about maintenance — and one of the biggest misconceptions we hear when it comes to divorce:

“Everything is split 50/50.”

❌ Not necessarily.

Maintenance is not automatically calculated as a 50/50 split between parents. It is determined by considering factors such as the child’s needs and the respective financial means of the parents.

In our new Demystifying Divorce series, our Family Law & Litigation Specialist, Leandré, will be unpacking some of the most common myths and misconceptions surrounding divorce and helping you understand what the law actually says.
