In South African law there is no such thing as a common law marriage.

Many people still believe that living together with another person for a certain number of years automatically entitles them to certain legal rights.

In simple terms, people living together do not have the rights and duties that married couples have. The only way to protect yourself and your assets is by entering into a Universal Partnership Agreement. However, it must be noted that this agreement is not enforceable against 3rd Parties (only a valid marriage is enforceable against 3rd Parties).

It is therefore advisable to consider entering into such an agreement, as it will provide some certainty regarding the division of assets and settlements of liability on termination of the relationship.
