• Travel visas rejected?
• Unable
to obtain a job locally or internationally?
• Unable to obtain credit?
• Unable to obtain a passport?
• Unable to immigrate due to papers being rejected?
• Unable to obtain a firearm license? A criminal record is often a stumbling block when applying for a job, getting credit, getting a visa, the emigration process and obtaining a firearm license. If you qualify for expungement, we can assist you in removing your criminal record. This means that your record will be expunged from the criminal record centre and resulting in a clear name when criminal record searches are done. Do You Qualify For Expungement of Your Criminal Record?
• Your conviction must be older than 10 years.
• Your sentence must have had the option of a fine.
• The conviction must not have resulted in mandatory jail time (this doesn’t include time spent following initial arrest and time spent awaiting trial).
• You must not have been imprisoned and convicted, without the option of a fine, of any other offence during the 10 years following your conviction. Typical Offences Which DO Qualify For Expungement
Typical offences which will qualify include non violent crimes such as petty theft, shoplifting, fraud, certain politically motivated crimes and crimes in respect of which the punishment is now unconstitutional such as corporal punishment. Each case will however have to be assessed on an individual basis and the determining factor in each instance will be the nature of the sentence imposed. Typical Offences Which DO NOT Qualify For Expungement
As a general rule, offences which have as their core element, violence, s*x or a combination of the two will not qualify. In most of these cases the sentence will be one of imprisonment without the option of a fine, examples would include:
• Murder
• R**e
• Sexual offences
• Armed robbery
• Assault with the intention to do grievous bodily harm (Assault GBH)
